55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the governor's broadband council.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 4, Government Code, is amended
1010 by adding Chapter 490H to read as follows:
1111 CHAPTER 490H. GOVERNOR'S BROADBAND COUNCIL
1212 Sec. 490H.001. DEFINITIONS. In this chapter:
1313 (1) "Broadband" means a service that provides advanced
1414 telecommunications capability and Internet access.
1515 (2) "Council" means the governor's broadband council.
1616 Sec. 490H.002. ESTABLISHMENT AND COMPOSITION. (a) The
1717 governor's broadband council is established in the office of the
1818 governor.
1919 (b) The council is composed of the following 15 voting
2020 members:
2121 (1) two representatives of unaffiliated Internet
2222 service providers, appointed by the governor;
2323 (2) one representative of a nonprofit organization
2424 that advocates for elderly persons statewide, appointed by the
2525 governor;
2626 (3) two representatives of unaffiliated nonprofit
2727 organizations that have a demonstrated history of working with the
2828 legislature and the public to identify solutions for expanding
2929 broadband to rural and underserved areas of this state, appointed
3030 by the governor;
3131 (4) one representative of an agricultural advocacy
3232 organization in this state, appointed by the governor;
3333 (5) one representative of a hospital advocacy
3434 organization in this state, appointed by the governor;
3535 (6) one representative of a medical advocacy
3636 organization in this state, appointed by the governor;
3737 (7) one county official who serves in an elected
3838 office of a county with a population of less than 35,000, appointed
3939 by the governor;
4040 (8) one municipal official who serves in an elected
4141 office of a municipality with a population of less than 20,000 that
4242 is located in a county with a population of less than 60,000,
4343 appointed by the governor;
4444 (9) one representative of an institution of higher
4545 education who has published scholarly research on broadband,
4646 appointed by the governor;
4747 (10) two members of the house of representatives,
4848 appointed by the speaker of the house of representatives; and
4949 (11) two members of the senate, appointed by the
5050 lieutenant governor.
5151 (c) A member of the council appointed under Subsection (b)
5252 serves for a five-year term.
5353 (d) A vacancy on the council is filled in the same manner as
5454 the original appointment.
5555 Sec. 490H.003. PRESIDING OFFICER. The governor shall
5656 designate the presiding officer of the council from among the
5757 members of the council.
5858 Sec. 490H.004. MEETINGS. (a) The council shall convene at
5959 least once every quarter.
6060 (b) The council shall convene at the call of the presiding
6161 officer.
6262 Sec. 490H.005. ADMINISTRATIVE SUPPORT. The governor's
6363 office shall provide administrative support to the council.
6464 Sec. 490H.006. DUTIES. The council shall:
6565 (1) research the past and present development of
6666 broadband in areas that are currently underserved and unserved with
6767 broadband;
6868 (2) identify barriers to residential and commercial
6969 broadband access in this state and to broadband development in this
7070 state and study solutions to overcome the identified barriers; and
7171 (3) analyze how statewide access to broadband would
7272 benefit:
7373 (A) economic development;
7474 (B) the delivery of educational opportunities in
7575 higher education and public education;
7676 (C) state and local law enforcement;
7777 (D) state emergency preparedness;
7878 (E) the delivery of health care services,
7979 including telemedicine and telehealth; and
8080 (F) any other matter related to the subject of
8181 broadband that a majority of the council members deem appropriate
8282 to research.
8383 Sec. 490H.007. ANNUAL REPORT. Not later than November 1 of
8484 each year, the council shall prepare and deliver a report in
8585 electronic format of its findings and recommendations to the
8686 governor, the lieutenant governor, and each member of the
8787 legislature.
8888 Sec. 490H.008. EXPIRATION. This chapter expires September
8989 1, 2029.
9090 SECTION 2. A report required under Section 490H.007,
9191 Government Code, as added by this Act, is not required to be
9292 prepared or submitted for the first time before November 1, 2020.
9393 SECTION 3. This Act takes effect immediately if it receives
9494 a vote of two-thirds of all the members elected to each house, as
9595 provided by Section 39, Article III, Texas Constitution. If this
9696 Act does not receive the vote necessary for immediate effect, this
9797 Act takes effect September 1, 2019.
