77 relating to imposing an additional fee for the registration of an
88 alternatively fueled vehicle.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.198(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Sections 502.058, 502.060,
1313 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and
1414 Subchapter H, this section applies to all fees collected by a county
1515 assessor-collector under this chapter.
1616 SECTION 2. Subchapter G, Chapter 502, Transportation Code,
1717 is amended by adding Section 502.360 to read as follows:
1818 Sec. 502.360. ADDITIONAL FEE FOR ALTERNATIVELY FUELED
1919 VEHICLES. (a) In this section, "alternatively fueled vehicle" has
2020 the meaning assigned by Section 502.004.
2121 (b) In addition to other fees authorized under this chapter,
2222 at the time of application for registration or renewal of
2323 registration of an alternatively fueled vehicle, the applicant
2424 shall pay an additional fee in an amount equal to the product of:
2525 (1) the number of miles driven by the alternatively
2626 fueled vehicle in the preceding year; and
2727 (2) the amount calculated under Subsection (c) for
2828 that class of vehicle.
2929 (c) The department shall, for each class of vehicle
3030 registered under this chapter, calculate the average amount of
3131 taxes imposed under Chapter 162, Tax Code, that a vehicle operating
3232 only on gasoline or diesel fuel pays for each mile driven.
3333 (d) Fees collected under this section shall be deposited to
3434 the credit of the state highway fund.
3535 (e) The board shall adopt rules necessary to administer
3636 registration for an alternatively fueled vehicle under this
3737 section.
3838 SECTION 3. This Act takes effect September 1, 2019.
