| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 502.198(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Sections 502.058, 502.060, |
|---|
| 13 | 13 | | 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and |
|---|
| 14 | 14 | | Subchapter H, this section applies to all fees collected by a county |
|---|
| 15 | 15 | | assessor-collector under this chapter. |
|---|
| 16 | 16 | | SECTION 2. Subchapter G, Chapter 502, Transportation Code, |
|---|
| 17 | 17 | | is amended by adding Section 502.360 to read as follows: |
|---|
| 18 | 18 | | Sec. 502.360. ADDITIONAL FEE FOR ALTERNATIVELY FUELED |
|---|
| 19 | 19 | | VEHICLES. (a) In this section, "alternatively fueled vehicle" has |
|---|
| 20 | 20 | | the meaning assigned by Section 502.004. |
|---|
| 21 | 21 | | (b) In addition to other fees authorized under this chapter, |
|---|
| 22 | 22 | | at the time of application for registration or renewal of |
|---|
| 23 | 23 | | registration of an alternatively fueled vehicle, the applicant |
|---|
| 24 | 24 | | shall pay an additional fee in an amount equal to the product of: |
|---|
| 25 | 25 | | (1) the number of miles driven by the alternatively |
|---|
| 26 | 26 | | fueled vehicle in the preceding year; and |
|---|
| 27 | 27 | | (2) the amount calculated under Subsection (c) for |
|---|
| 28 | 28 | | that class of vehicle. |
|---|
| 29 | 29 | | (c) The department shall, for each class of vehicle |
|---|
| 30 | 30 | | registered under this chapter, calculate the average amount of |
|---|
| 31 | 31 | | taxes imposed under Chapter 162, Tax Code, that a vehicle operating |
|---|
| 32 | 32 | | only on gasoline or diesel fuel pays for each mile driven. |
|---|
| 33 | 33 | | (d) Fees collected under this section shall be deposited to |
|---|
| 34 | 34 | | the credit of the state highway fund. |
|---|
| 35 | 35 | | (e) The board shall adopt rules necessary to administer |
|---|
| 36 | 36 | | registration for an alternatively fueled vehicle under this |
|---|
| 37 | 37 | | section. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2019. |
