55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring notices of property located in floodplains,
88 flood pools, or reservoirs to be provided by sellers of real
99 property and on subdivision plats.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 212.004, Local Government Code, is
1212 amended by amending Subsection (b) and adding Subsection (f) to
1313 read as follows:
1414 (b) To be recorded, the plat must:
1515 (1) describe the subdivision by metes and bounds;
1616 (2) locate the subdivision with respect to a corner of
1717 the survey or tract or an original corner of the original survey of
1818 which it is a part; [and]
1919 (3) state the dimensions of the subdivision and of
2020 each street, alley, square, park, or other part of the tract
2121 intended to be dedicated to public use or for the use of purchasers
2222 or owners of lots fronting on or adjacent to the street, alley,
2323 square, park, or other part; and
2424 (4) include a certification by a surveyor or engineer
2525 registered to practice in this state describing any area of the
2626 subdivision that is in a 100-year floodplain, 500-year floodplain,
2727 flood pool, or reservoir or stating that no area is in a 100-year
2828 floodplain, 500-year floodplain, flood pool, or reservoir.
2929 (f) In this section, "100-year floodplain," "500-year
3030 floodplain," "flood pool," and "reservoir" have the meanings
3131 assigned by Section 5.020, Property Code.
3232 SECTION 2. Section 232.001, Local Government Code, is
3333 amended by amending Subsection (b) and adding Subsection (g) to
3434 read as follows:
3535 (b) To be recorded, the plat must:
3636 (1) describe the subdivision by metes and bounds;
3737 (2) locate the subdivision with respect to an original
3838 corner of the original survey of which it is a part; [and]
3939 (3) state the dimensions of the subdivision and of
4040 each lot, street, alley, square, park, or other part of the tract
4141 intended to be dedicated to public use or for the use of purchasers
4242 or owners of lots fronting on or adjacent to the street, alley,
4343 square, park, or other part; and
4444 (4) include a certification by a surveyor or engineer
4545 registered to practice in this state describing any area of the
4646 subdivision that is in a 100-year floodplain, 500-year floodplain,
4747 flood pool, or reservoir or stating that no area is in a 100-year
4848 floodplain, 500-year floodplain, flood pool, or reservoir.
4949 (g) In this section, "100-year floodplain," "500-year
5050 floodplain," "flood pool," and "reservoir" have the meanings
5151 assigned by Section 5.020, Property Code.
5252 SECTION 3. Section 232.021, Local Government Code, is
5353 amended by amending Subdivisions (1) and (4) and adding
5454 Subdivisions (1-a) and (8-a) to read as follows:
5555 (1) "100-year floodplain" and "500-year floodplain"
5656 have the meanings assigned by Section 5.020, Property Code.
5757 (1-a) "Board" means the Texas Water Development Board.
5858 (4) "Flood pool" has the meaning assigned by Section
5959 5.020, Property Code ["Floodplain" means any area in the 100-year
6060 floodplain that is susceptible to being inundated by water from any
6161 source or that is identified by the Federal Emergency Management
6262 Agency under the National Flood Insurance Act of 1968 (42 U.S.C.
6363 Sections 4001 through 4127)].
6464 (8-a) "Reservoir" has the meaning assigned by Section
6565 5.020, Property Code.
6666 SECTION 4. Section 232.023(b), Local Government Code, is
6767 amended to read as follows:
6868 (b) A plat required under this section must:
6969 (1) be certified by a surveyor or engineer registered
7070 to practice in this state;
7171 (2) define the subdivision by metes and bounds;
7272 (3) locate the subdivision with respect to an original
7373 corner of the original survey of which it is a part;
7474 (4) describe each lot, number each lot in progression,
7575 and give the dimensions of each lot;
7676 (5) state the dimensions of and accurately describe
7777 each lot, street, alley, square, park, or other part of the tract
7878 intended to be dedicated to public use or for the use of purchasers
7979 or owners of lots fronting on or adjacent to the street, alley,
8080 square, park, or other part;
8181 (6) include or have attached a document containing a
8282 description in English and Spanish of the water and sewer
8383 facilities and roadways and easements dedicated for the provision
8484 of water and sewer facilities that will be constructed or installed
8585 to service the subdivision and a statement specifying the date by
8686 which the facilities will be fully operable;
8787 (7) have attached a document prepared by an engineer
8888 registered to practice in this state certifying that the water and
8989 sewer service facilities proposed under Subdivision (6) are in
9090 compliance with the model rules adopted under Section 16.343, Water
9191 Code, and a certified estimate of the cost to install water and
9292 sewer service facilities;
9393 (8) provide for drainage in the subdivision to:
9494 (A) avoid concentration of storm drainage water
9595 from each lot to adjacent lots;
9696 (B) provide positive drainage away from all
9797 buildings; and
9898 (C) coordinate individual lot drainage with the
9999 general storm drainage pattern for the area;
100100 (9) include a description of the drainage requirements
101101 as provided in Subdivision (8);
102102 (10) identify the topography of the area;
103103 (11) include a certification by a surveyor or engineer
104104 registered to practice in this state describing any area of the
105105 subdivision that is in a 100-year floodplain, 500-year floodplain,
106106 flood pool, or reservoir or stating that no area is in a 100-year
107107 floodplain, 500-year floodplain, flood pool, or reservoir; and
108108 (12) include certification that the subdivider has
109109 complied with the requirements of Section 232.032 and that:
110110 (A) the water quality and connections to the lots
111111 meet, or will meet, the minimum state standards;
112112 (B) sewer connections to the lots or septic tanks
113113 meet, or will meet, the minimum requirements of state standards;
114114 (C) electrical connections provided to the lot
115115 meet, or will meet, the minimum state standards; and
116116 (D) gas connections, if available, provided to
117117 the lot meet, or will meet, the minimum state standards.
118118 SECTION 5. Section 232.024(b), Local Government Code, is
119119 amended to read as follows:
120120 (b) If any part of a plat applies to land intended for
121121 residential housing and any part of that land lies in a 100-year
122122 floodplain, the commissioners court shall not approve the plat
123123 unless:
124124 (1) the subdivision is developed in compliance with
125125 the minimum requirements of the National Flood Insurance Program
126126 and local regulations or orders adopted under Section 16.315, Water
127127 Code; and
128128 (2) the plat evidences a restrictive covenant
129129 prohibiting the construction of residential housing in any area of
130130 the subdivision that is in a 100-year floodplain unless the housing
131131 is developed in compliance with the minimum requirements of the
132132 National Flood Insurance Program and local regulations or orders
133133 adopted under Section 16.315, Water Code.
134134 SECTION 6. Section 5.008(b), Property Code, is amended to
135135 read as follows:
136136 (b) The notice must be executed and must, at a minimum, read
137137 substantially similar to the following:

380380 SECTION 7. Subchapter A, Chapter 5, Property Code, is
381381 amended by adding Section 5.020 to read as follows:
382382 Sec. 5.020. NOTICE OF FLOODPLAIN, FLOOD POOL, OR RESERVOIR.
383383 (a) In this section:
384384 (1) "100-year floodplain" means any area of land that
385385 is identified as an area that has a one percent chance of being
386386 inundated by a flood event each year on a flood insurance rate map.
387387 (2) "500-year floodplain" means any area of land that
388388 is identified as an area that has a two-tenths of one percent chance
389389 of being inundated by a flood event each year on a flood insurance
390390 rate map.
391391 (3) "Flood pool" means the area adjacent to a
392392 reservoir that lies above the normal maximum operating level of the
393393 reservoir and that is subject to controlled inundation under the
394394 management of the United States Army Corps of Engineers.
395395 (4) "Flood insurance rate map" means the most recent
396396 flood hazard map published by the Federal Emergency Management
397397 Agency under the National Flood Insurance Act of 1968 (42 U.S.C.
398398 Section 4001 et seq.).
399399 (5) "Reservoir" means a water impoundment project
400400 operated by the United States Army Corps of Engineers that is
401401 intended to retain water or delay the runoff of water in a
402402 designated surface area of land.
403403 (b) This section applies only to the sale of residential or
404404 commercial real property located in a 100-year floodplain, 500-year
405405 floodplain, flood pool, or reservoir.
406406 (c) On or before the date a seller of real property and a
407407 purchaser enter into a contract binding the purchaser to purchase
408408 the property, the seller shall give to the purchaser a signed,
409409 written notice in substantially the following form:

430430 (1) the notice from the seller; or
431431 (2) information described by the notice under
432432 Subsection (c) from any other person.
433433 (e) After the date of the conveyance, the purchaser may
434434 bring an action for misrepresentation against the seller if the
435435 seller:
436436 (1) failed to provide the notice before the date of the
437437 conveyance; and
438438 (2) had actual knowledge that the property was located
439439 in a 100-year floodplain, 500-year floodplain, flood pool, or
440440 reservoir.
441441 SECTION 8. (a) The changes in law made by this Act to
442442 Sections 212.004, 232.001, 232.021, and 232.023, Local Government
443443 Code, apply only to a subdivision plat application submitted for
444444 approval on or after the effective date of this Act. A subdivision
445445 plat application submitted for approval before the effective date
446446 of this Act is governed by the law in effect on the date the
447447 application was submitted, and that law is continued in effect for
448448 that purpose.
449449 (b) The changes in law made by this Act in amending Section
450450 5.008, Property Code, and adding Section 5.020, Property Code,
451451 apply only to a contract for the sale of real property entered into
452452 on or after the effective date of this Act. A contract entered into
453453 before the effective date of this Act is governed by the law in
454454 effect on the date the contract was entered into, and that law is
455455 continued in effect for that purpose.
456456 SECTION 9. This Act takes effect September 1, 2019.
