10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 212.004, Local Government Code, is |
---|
12 | 12 | | amended by amending Subsection (b) and adding Subsection (f) to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (b) To be recorded, the plat must: |
---|
15 | 15 | | (1) describe the subdivision by metes and bounds; |
---|
16 | 16 | | (2) locate the subdivision with respect to a corner of |
---|
17 | 17 | | the survey or tract or an original corner of the original survey of |
---|
18 | 18 | | which it is a part; [and] |
---|
19 | 19 | | (3) state the dimensions of the subdivision and of |
---|
20 | 20 | | each street, alley, square, park, or other part of the tract |
---|
21 | 21 | | intended to be dedicated to public use or for the use of purchasers |
---|
22 | 22 | | or owners of lots fronting on or adjacent to the street, alley, |
---|
23 | 23 | | square, park, or other part; and |
---|
24 | 24 | | (4) include a certification by a surveyor or engineer |
---|
25 | 25 | | registered to practice in this state describing any area of the |
---|
26 | 26 | | subdivision that is in a 100-year floodplain, 500-year floodplain, |
---|
27 | 27 | | flood pool, or reservoir or stating that no area is in a 100-year |
---|
28 | 28 | | floodplain, 500-year floodplain, flood pool, or reservoir. |
---|
29 | 29 | | (f) In this section, "100-year floodplain," "500-year |
---|
30 | 30 | | floodplain," "flood pool," and "reservoir" have the meanings |
---|
31 | 31 | | assigned by Section 5.020, Property Code. |

32 | 32 | | SECTION 2. Section 232.001, Local Government Code, is |
---|
33 | 33 | | amended by amending Subsection (b) and adding Subsection (g) to |
---|

53 | 53 | | amended by amending Subdivisions (1) and (4) and adding |
---|
54 | 54 | | Subdivisions (1-a) and (8-a) to read as follows: |
---|
55 | 55 | | (1) "100-year floodplain" and "500-year floodplain" |
---|
56 | 56 | | have the meanings assigned by Section 5.020, Property Code. |
---|
57 | 57 | | (1-a) "Board" means the Texas Water Development Board. |
---|
58 | 58 | | (4) "Flood pool" has the meaning assigned by Section |
---|
59 | 59 | | 5.020, Property Code ["Floodplain" means any area in the 100-year |
---|
60 | 60 | | floodplain that is susceptible to being inundated by water from any |
---|
61 | 61 | | source or that is identified by the Federal Emergency Management |
---|
62 | 62 | | Agency under the National Flood Insurance Act of 1968 (42 U.S.C. |
---|
63 | 63 | | Sections 4001 through 4127)]. |
---|
64 | 64 | | (8-a) "Reservoir" has the meaning assigned by Section |
---|
65 | 65 | | 5.020, Property Code. |
---|
66 | 66 | | SECTION 4. Section 232.023(b), Local Government Code, is |
---|
67 | 67 | | amended to read as follows: |
---|
68 | 68 | | (b) A plat required under this section must: |
---|
69 | 69 | | (1) be certified by a surveyor or engineer registered |
---|
70 | 70 | | to practice in this state; |
---|
71 | 71 | | (2) define the subdivision by metes and bounds; |
---|
72 | 72 | | (3) locate the subdivision with respect to an original |
---|
73 | 73 | | corner of the original survey of which it is a part; |
---|
74 | 74 | | (4) describe each lot, number each lot in progression, |
---|
75 | 75 | | and give the dimensions of each lot; |
---|
76 | 76 | | (5) state the dimensions of and accurately describe |
---|
77 | 77 | | each lot, street, alley, square, park, or other part of the tract |
---|
78 | 78 | | intended to be dedicated to public use or for the use of purchasers |
---|
79 | 79 | | or owners of lots fronting on or adjacent to the street, alley, |
---|
80 | 80 | | square, park, or other part; |
---|
81 | 81 | | (6) include or have attached a document containing a |
---|
82 | 82 | | description in English and Spanish of the water and sewer |
---|
83 | 83 | | facilities and roadways and easements dedicated for the provision |
---|
84 | 84 | | of water and sewer facilities that will be constructed or installed |
---|
85 | 85 | | to service the subdivision and a statement specifying the date by |
---|
86 | 86 | | which the facilities will be fully operable; |
---|
87 | 87 | | (7) have attached a document prepared by an engineer |
---|
88 | 88 | | registered to practice in this state certifying that the water and |
---|
89 | 89 | | sewer service facilities proposed under Subdivision (6) are in |
---|
90 | 90 | | compliance with the model rules adopted under Section 16.343, Water |
---|
91 | 91 | | Code, and a certified estimate of the cost to install water and |
---|
92 | 92 | | sewer service facilities; |
---|
93 | 93 | | (8) provide for drainage in the subdivision to: |
---|
94 | 94 | | (A) avoid concentration of storm drainage water |
---|
95 | 95 | | from each lot to adjacent lots; |
---|
96 | 96 | | (B) provide positive drainage away from all |
---|
97 | 97 | | buildings; and |
---|
98 | 98 | | (C) coordinate individual lot drainage with the |
---|
99 | 99 | | general storm drainage pattern for the area; |
---|
100 | 100 | | (9) include a description of the drainage requirements |
---|
101 | 101 | | as provided in Subdivision (8); |
---|
102 | 102 | | (10) identify the topography of the area; |
---|
103 | 103 | | (11) include a certification by a surveyor or engineer |
---|
104 | 104 | | registered to practice in this state describing any area of the |
---|
105 | 105 | | subdivision that is in a 100-year floodplain, 500-year floodplain, |
---|

111 | 111 | | meet, or will meet, the minimum state standards; |

112 | 112 | | (B) sewer connections to the lots or septic tanks |
---|
113 | 113 | | meet, or will meet, the minimum requirements of state standards; |
---|
114 | 114 | | (C) electrical connections provided to the lot |
---|
115 | 115 | | meet, or will meet, the minimum state standards; and |
---|
116 | 116 | | (D) gas connections, if available, provided to |
---|
117 | 117 | | the lot meet, or will meet, the minimum state standards. |
---|
118 | 118 | | SECTION 5. Section 232.024(b), Local Government Code, is |
---|
119 | 119 | | amended to read as follows: |
---|
120 | 120 | | (b) If any part of a plat applies to land intended for |
---|
121 | 121 | | residential housing and any part of that land lies in a 100-year |
---|
122 | 122 | | floodplain, the commissioners court shall not approve the plat |
---|

124 | 124 | | (1) the subdivision is developed in compliance with |

125 | 125 | | the minimum requirements of the National Flood Insurance Program |

126 | 126 | | and local regulations or orders adopted under Section 16.315, Water |
