6	6	AN ACT
7	7	relating to the release of a reversionary interest in certain real
8	8	property by the Health and Human Services Commission and conditions
9	9	related to that release.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. (a) Subject to Subsections (b) and (c) of this
12	12	section and not later than February 1, 2021, the Health and Human
13	13	Services Commission shall execute an appropriate instrument to
14	14	release and nullify the right of reverter to which the real property
15	15	described by Section 2 of this Act is subject under the deed filed
16	16	in the Deed Records of Howard County, Texas, at Volume 795, Pages
17	17	141-143.
18	18	(b) The Health and Human Services Commission shall by
19	19	appropriate instrument release the right of reverter described by
20	20	Subsection (a) of this section only if:
21	21	(1) the West Texas Centers for Mental Health and
22	22	Mental Retardation transfers by appropriate instrument of
23	23	conveyance to Cap Rock Holdings, LLC, a Texas limited liability
24	24	company, real property described by Section 2 of this Act in
25	25	exchange for the real property described by Section 3 of this Act
26	26	transferred by appropriate instrument of conveyance by Cap Rock
27	27	Holdings, LLC, a Texas limited liability company, to West Texas
28	28	Centers for Mental Health and Mental Retardation;
29	29	(2) the fair market value of the real property
30	30	described by Section 3 of this Act is equal to or greater than the
31	31	fair market value of the real property described by Section 2 of
32	32	this Act as established by an independent appraisal obtained by the
33	33	asset management division of the General Land Office; and
34	34	(3) the real property described by Section 3 of this
35	35	Act is conveyed to the West Texas Centers for Mental Health and
36	36	Mental Retardation by Cap Rock Holdings, LLC, a Texas limited
37	37	liability company, by appropriate instrument of conveyance that
38	38	includes a provision that imposes as a condition on title to the
39	39	real property that the title will automatically vest in the Health
40	40	and Human Services Commission if the West Texas Centers for Mental
41	41	Health and Mental Retardation discontinues using the property for
42	42	the purpose of providing community-based mental health and
43	43	intellectual disability services for more than 180 continuous days.
44	44	(c) The Health and Human Services Commission may execute the
45	45	instrument releasing the right of reverter described by Subsection
46	46	(a) of this section to nullify the right of reverter and clear the
47	47	right of reverter from the title of the real property described by
48	48	Section 2 of this Act only if the General Land Office has verified
49	49	that the conditions described by Subsection (b) of this section
50	50	have been satisfied.
51	51	SECTION 2. The real property title to which is held by the
52	52	West Texas Centers for Mental Health and Mental Retardation is
53	53	situated in Howard County, Texas, and more particularly described
54	54	as follows:
55	55	Lots 5, 6 and 7, Block 19, Original Town Site, Big Spring, Howard
56	56	County, Texas and further described as being a +/- 0.48-acre tract
57	57	in a deed to the State recorded at Volume 642, Page 480, of the Deed
58	58	Records of Howard County, Texas.
59	59	SECTION 3. The real property title to which is held by Cap
60	60	Rock Holdings, LLC, a Texas limited liability company, is situated
61	61	in Howard County, Texas, and more particularly described as
62	62	follows:

70	70	SECTION 4. This Act takes effect immediately if it receives
71	71	a vote of two-thirds of all the members elected to each house, as
72	72	provided by Section 39, Article III, Texas Constitution. If this
73	73	Act does not receive the vote necessary for immediate effect, this
74	74	Act takes effect September 1, 2019.
