57 relating to continuing education requirements for surgical

79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. The heading to Section 259.002, Health and
911 Safety Code, is amended to read as follows:
1012 Sec. 259.002. REQUIREMENTS FOR PRACTICING SURGICAL
1113 TECHNOLOGY; CONTINUING EDUCATION.
1214 SECTION 2. Section 259.002, Health and Safety Code, is
1315 amended by adding Subsections (d), (e), and (f) to read as follows:
1416 (d) A person employed by a health care facility to practice
1517 surgical technology under Subsection (a)(1) shall complete the
1618 number of hours of continuing education required to maintain
1719 certification by the organization that issued the surgical
1820 technologist certification to the person. On the facility's
1921 request, the person shall submit to the facility evidence of
2022 completion of the continuing education.
2123 (e) A person employed by a health care facility to practice
2224 surgical technology under Subsection (a)(2) or (3) or Subsection
2325 (c) shall complete every two years 30 hours of continuing education
2426 related to surgical technology. On the facility's request, the
2527 person shall submit to the facility evidence of completion of the
2628 continuing education.
2729 (f) A health care facility may restrict the ability of a
2830 person employed by the facility to practice surgical technology in
2931 the facility if the person fails to complete the continuing
3032 education required by Subsection (d) or (e).
3133 SECTION 3. Notwithstanding Sections 259.002(d) and (e),
3234 Health and Safety Code, as added by this Act, a person employed by a
3335 health care facility to practice surgical technology is not
3436 required to complete the continuing education before September 1,
3537 2020.
3638 SECTION 4. This Act takes effect September 1, 2019.
