| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. The heading to Section 259.002, Health and |
|---|
| 9 | 11 | | Safety Code, is amended to read as follows: |

| 10 | 12 | | Sec. 259.002. REQUIREMENTS FOR PRACTICING SURGICAL |
|---|
| 11 | 13 | | TECHNOLOGY; CONTINUING EDUCATION. |
|---|
| 12 | 14 | | SECTION 2. Section 259.002, Health and Safety Code, is |
|---|
| 13 | 15 | | amended by adding Subsections (d), (e), and (f) to read as follows: |
|---|
| 14 | 16 | | (d) A person employed by a health care facility to practice |
|---|
| 15 | 17 | | surgical technology under Subsection (a)(1) shall complete the |
|---|
| 16 | 18 | | number of hours of continuing education required to maintain |
|---|
| 17 | 19 | | certification by the organization that issued the surgical |
|---|
| 18 | 20 | | technologist certification to the person. On the facility's |
|---|
| 19 | 21 | | request, the person shall submit to the facility evidence of |
|---|
| 20 | 22 | | completion of the continuing education. |
|---|
| 21 | 23 | | (e) A person employed by a health care facility to practice |
|---|
| 22 | 24 | | surgical technology under Subsection (a)(2) or (3) or Subsection |
|---|
| 23 | 25 | | (c) shall complete every two years 30 hours of continuing education |
|---|
| 24 | 26 | | related to surgical technology. On the facility's request, the |
|---|
| 25 | 27 | | person shall submit to the facility evidence of completion of the |
|---|
| 26 | 28 | | continuing education. |
|---|
| 27 | 29 | | (f) A health care facility may restrict the ability of a |
|---|
| 28 | 30 | | person employed by the facility to practice surgical technology in |
|---|
| 29 | 31 | | the facility if the person fails to complete the continuing |
|---|
| 30 | 32 | | education required by Subsection (d) or (e). |
|---|
| 31 | 33 | | SECTION 3. Notwithstanding Sections 259.002(d) and (e), |
|---|
| 32 | 34 | | Health and Safety Code, as added by this Act, a person employed by a |
|---|
| 33 | 35 | | health care facility to practice surgical technology is not |
|---|
| 34 | 36 | | required to complete the continuing education before September 1, |
|---|
| 35 | 37 | | 2020. |
|---|
| 36 | 38 | | SECTION 4. This Act takes effect September 1, 2019. |
