| 13 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 10 | | SECTION 1. Section 43.007(m), Election Code, is amended to |
|---|
| 15 | 11 | | read as follows: |
|---|
| 16 | 12 | | (m) In adopting a methodology under Subsection (f), the |
|---|
| 17 | 13 | | county must ensure that: |
|---|
| 18 | 14 | | (1) each county commissioners precinct contains at |
|---|
| 19 | 15 | | least one countywide polling place and the percentage of the total |
|---|
| 20 | 16 | | number of countywide polling places located in each commissioners |
|---|
| 21 | 17 | | precinct must be as equal as mathematically possible to the |
|---|
| 22 | 18 | | percentage of registered voters of the county whose registrations |
|---|
| 23 | 19 | | are effective on the date of the election residing in each |
|---|
| 24 | 20 | | commissioners precinct; and |
|---|
| 25 | 21 | | (2) in a county with a population of 400,000 or more, |
|---|
| 26 | 22 | | the percentage of the total number of countywide polling places |
|---|
| 27 | 23 | | located in each state representative district in the county |
|---|
| 28 | 24 | | containing territory in which the election is held must be as equal |
|---|
| 29 | 25 | | as mathematically possible to the percentage of registered voters |
|---|
| 30 | 26 | | of the county whose registrations are effective on the date of the |
