55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to Medicaid reimbursement for dental services provided to
88 certain Medicaid recipients.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.054, Human Resources Code, is amended
1111 by adding Subsections (f) and (g) to read as follows:
1212 (f) In addition to any emergency dental services already
1313 covered under the medical assistance program, the commission shall
1414 provide medical assistance reimbursement in an annual amount of not
1515 more than $750 for preventive dental services, including diagnostic
1616 services, tooth extractions, fillings, and annual cleanings, for
1717 recipients who are 21 years of age or older.
1818 (g) The commission shall provide medical assistance
1919 reimbursement for the medically necessary use of anesthesia during
2020 a dental service, as determined by the dentist performing the
2121 service, for a recipient with a disability or a recipient who is
2222 receiving treatment by an oral surgeon. The use of anesthesia is
2323 excluded from the annual maximum benefit amount under Subsection
2424 (f).
2525 SECTION 2. If before implementing any provision of this Act
2626 a state agency determines that a waiver or authorization from a
2727 federal agency is necessary for implementation of that provision,
2828 the agency affected by the provision shall request the waiver or
2929 authorization and may delay implementing that provision until the
3030 waiver or authorization is granted.
3131 SECTION 3. This Act takes effect September 1, 2019.
