7 | 7 | | relating to Medicaid reimbursement for dental services provided to |

8 | 8 | | certain Medicaid recipients. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 32.054, Human Resources Code, is amended |
---|
11 | 11 | | by adding Subsections (f) and (g) to read as follows: |
---|
12 | 12 | | (f) In addition to any emergency dental services already |
---|
13 | 13 | | covered under the medical assistance program, the commission shall |
---|
14 | 14 | | provide medical assistance reimbursement in an annual amount of not |
---|
15 | 15 | | more than $750 for preventive dental services, including diagnostic |
---|
16 | 16 | | services, tooth extractions, fillings, and annual cleanings, for |
---|
17 | 17 | | recipients who are 21 years of age or older. |
---|
18 | 18 | | (g) The commission shall provide medical assistance |
---|
19 | 19 | | reimbursement for the medically necessary use of anesthesia during |
---|
20 | 20 | | a dental service, as determined by the dentist performing the |
---|
21 | 21 | | service, for a recipient with a disability or a recipient who is |
---|
22 | 22 | | receiving treatment by an oral surgeon. The use of anesthesia is |
---|
23 | 23 | | excluded from the annual maximum benefit amount under Subsection |
---|
24 | 24 | | (f). |
---|
25 | 25 | | SECTION 2. If before implementing any provision of this Act |
---|
26 | 26 | | a state agency determines that a waiver or authorization from a |
---|
27 | 27 | | federal agency is necessary for implementation of that provision, |
---|
28 | 28 | | the agency affected by the provision shall request the waiver or |
---|
29 | 29 | | authorization and may delay implementing that provision until the |
---|
30 | 30 | | waiver or authorization is granted. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2019. |
