66 AN ACT
77 relating to health benefit coverage provided by certain health
88 benefit plans for telemedicine medical services and telehealth
99 services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1455.004, Insurance Code, is amended by
1212 adding Subsection (d) to read as follows:
1313 (d) Notwithstanding Subsection (c), a health benefit plan
1414 that provides coverage for telemedicine medical services or
1515 telehealth services may not deny payment to a preferred or
1616 contracted health professional for a covered claim for a
1717 telemedicine medical service or telehealth service based solely on
1818 the telecommunications or information technology vendor used by the
1919 health professional to deliver the service if the method of
2020 communication that the vendor provides complies with Chapter 111,
2121 Occupations Code, as applicable.
2222 SECTION 2. This Act applies only to a health benefit plan
2323 that is delivered, issued for delivery, or renewed on or after
2424 January 1, 2020.
2525 SECTION 3. This Act takes effect September 1, 2019.
