10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 1455.004, Insurance Code, is amended by | |
12 | 12 | adding Subsection (d) to read as follows: | |
13 | 13 | (d) Notwithstanding Subsection (c), a health benefit plan | |
14 | 14 | that provides coverage for telemedicine medical services or | |
15 | 15 | telehealth services may not deny payment to a preferred or | |
16 | 16 | contracted health professional for a covered claim for a | |
17 | 17 | telemedicine medical service or telehealth service based solely on | |
18 | 18 | the telecommunications or information technology vendor used by the | |
19 | 19 | health professional to deliver the service if the method of | |
20 | 20 | communication that the vendor provides complies with Chapter 111, | |
21 | 21 | Occupations Code, as applicable. | |
22 | 22 | SECTION 2. This Act applies only to a health benefit plan | |
23 | 23 | that is delivered, issued for delivery, or renewed on or after | |
24 | 24 | January 1, 2020. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2019. |
