118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Sections 5A(a)(4) and (5), Chapter 1507 (S.B.
1310 456), Acts of the 76th Legislature, Regular Session, 1999 (Article
1411 5190.14, Vernon's Texas Civil Statutes), are amended to read as
1512 follows:
1613 (4) "Event" means a Super Bowl, a National Collegiate
1714 Athletic Association Final Four tournament game, the National
1815 Basketball Association All-Star Game, the X Games, the National
1916 Hockey League All-Star Game, the Major League Baseball All-Star
2017 Game, a game of the National Collegiate Athletic Association Bowl
2118 Championship Series or its successor or a National Collegiate
2219 Athletic Association Division I Football Bowl Subdivision
2320 postseason playoff or championship game, the National Collegiate
2421 Athletic Association men's or women's lacrosse championships, a
2522 World Cup Soccer game, the World Cup soccer tournament, the Major
2623 League Soccer All-Star Game, the Major League Soccer Cup, the
2724 Professional Rodeo Cowboys Association National Finals Rodeo, an
2825 Elite Rodeo Association World Championship, the United States Open
2926 Championship, the World Games, a national collegiate championship
3027 of an amateur sport sanctioned by the national governing body of the
3128 sport that is recognized by the United States Olympic Committee, an
3229 Olympic activity, including a Junior or Senior activity, training
3330 program, or feeder program sanctioned by the United States Olympic
3431 Committee's Community Olympic Development Program, the Amateur
3532 Athletic Union Junior Olympic Games, a mixed martial arts
3633 championship, the Breeders' Cup World Championships, a Formula One
3734 automobile race, the Moto Grand Prix of the United States, the
3835 National Association for Stock Car Auto Racing (NASCAR) All-Star
3936 Race, the season-ending Championship Race for the National
4037 Association for Stock Car Auto Racing (NASCAR), the Academy of
4138 Country Music Awards, the National Cutting Horse Association Triple
42- Crown, a world-renowned exhibition or festival chronicling the life
43- of Nelson Mandela that is recognized by the International World
44- Exhibition & Festival Organization, a national political
45- convention of the Republican National Committee or the Democratic
46- National Committee, a presidential general election debate, or the
47- largest event held each year at a sports entertainment venue in this
48- state with a permanent seating capacity, including grandstand and
49- premium seating, of not less than 125,000. The term includes any
50- activities related to or associated with an event.
39+ Crown, a world-renowned exhibition or festival that is recognized
40+ by the International World Exhibition & Festival Organization, a
41+ national political convention of the Republican National Committee
42+ or the Democratic National Committee, a presidential general
43+ election debate, or the largest event held each year at a sports
44+ entertainment venue in this state with a permanent seating
45+ capacity, including grandstand and premium seating, of not less
46+ than 125,000. The term includes any activities related to or
47+ associated with an event.
5148 (5) "Site selection organization" means:
5249 (A) the National Football League, the National
5350 Collegiate Athletic Association, the National Basketball
5451 Association, ESPN or an affiliate, the National Hockey League,
5552 Major League Baseball, the Federation Internationale de Football
5653 Association (FIFA), the International World Games Association, the
5754 National Association for Stock Car Auto Racing (NASCAR), Dorna
5855 Sports, the Amateur Athletic Union, the Professional Rodeo Cowboys
5956 Association, the Elite Rodeo Association, Major League Soccer, the
6057 United States Golf Association, or the United States Olympic
6158 Committee;
6259 (B) the national governing body of a sport that
6360 is recognized by the United States Olympic Committee, the National
6461 Thoroughbred Racing Association, Formula One Management Limited,
6562 or the Federation Internationale de l'Automobile;
6663 (C) the Academy of Country Music;
6764 (D) the National Cutting Horse Association;
6865 (E) the International World Exhibition &
6966 Festival Organization;
7067 (F) [(E)] the Republican National Committee or
7168 the Democratic National Committee;
7269 (G) [(F)] the Ultimate Fighting Championship; or
7370 (H) [(G)] the Commission on Presidential
7471 Debates.
75- SECTION 2. Section 5A, Chapter 1507 (S.B. 456), Acts of the
76- 76th Legislature, Regular Session, 1999 (Article 5190.14, Vernon's
77- Texas Civil Statutes), is amended by amending Subsection (a-1) and
78- adding Subsection (a-5) to read as follows:
79- (a-1) An event not listed in Subsection (a)(4) of this
80- section is ineligible for funding under this section. A listed
81- event may receive funding through the Major Events Reimbursement
82- Program under this section only if:
83- (1) a site selection organization selects a site
84- located in this state for the event to be held one time or, for an
85- event scheduled to be held each year for a period of years under an
86- event contract, or an event support contract, one time each year for
87- the period of years, after considering, through a highly
88- competitive selection process, one or more sites that are not
89- located in this state;
90- (2) a site selection organization selects a site in
91- this state as:
92- (A) the sole site for the event; or
93- (B) the sole site for the event in a region
94- composed of this state and one or more adjoining states;
95- (3) the event is held not more than one time in any
96- year;
97- (4) the amount of the incremental increase in tax
98- receipts determined by the department under Subsection (b) of this
99- section equals or exceeds $1 million, provided that for an event
100- scheduled to be held each year for a period of years under an event
101- contract or event support contract, the incremental increase in tax
102- receipts shall be calculated as if the event did not occur in the
103- prior year; and
104- (5) not later than the 30th day before the first day of
105- the event, a site selection organization or the organization
106- hosting the event submits a plan to prevent the trafficking of
107- persons in connection with the event to the office of the attorney
108- general, the human trafficking prevention task force established
109- under Section 402.035, Government Code, and the chief of the Texas
110- Division of Emergency Management.
111- (a-5) If the department determines an event is ineligible to
112- receive funding through the Major Events Reimbursement Program due
113- solely to a failure to timely submit a plan as required by
114- Subsection (a-1)(5) of this section, the event may receive funding
115- through the program if:
116- (1) the plan required by that subdivision is submitted
117- to the required entities not later than seven days before the event
118- begins and is implemented during the event; and
119- (2) all other requirements for funding under this
120- section, including those imposed by Subsections (d-1) and (w) of
121- this section, are satisfied not later than the 60th day after the
122- last day of the fiscal year in which the event occurs, provided
123- submission of the plan required by Subsection (a-1)(5) of this
124- section was not previously required under this section for that
125- event.
126- SECTION 3. Section 5A(a-1), Chapter 1507 (S.B. 456), Acts
127- of the 76th Legislature, Regular Session, 1999 (Article 5190.14,
128- Vernon's Texas Civil Statutes), as amended by this Act, and Section
129- 5A(a-5), Chapter 1507 (S.B. 456), Acts of the 76th Legislature,
130- Regular Session, 1999 (Article 5190.14, Vernon's Texas Civil
131- Statutes), as added by this Act, apply to an event that occurs
132- before, on, or after the effective date of this Act.
133- SECTION 4. This Act takes effect immediately if it receives
