87 practices.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 264.201(d), Family Code, is amended to
1110 read as follows:
1211 (d) The services may include in-home programs, parenting
1312 skills training, youth coping skills, and individual and family
1413 counseling. If the department requires or a court orders parenting
1514 skills training services through a parenting education program or
1615 practice, the program or practice must be an evidence-based program
1716 or practice, promising [practice parenting education] program or
1817 practice, or evidence-informed program or practice described by
1918 Section 265.151 that is provided in the community in which the
2019 family resides, if available.
2120 SECTION 2. Section 265.004(a-1), Family Code, is amended to
2221 read as follows:
2322 (a-1) The department shall ensure that not less than 75
2423 percent of the money appropriated for home visiting programs and
2524 parenting education programs under Subsection (a) funds
2625 evidence-based programs or practices described by Section
2726 265.151(b) and that the remainder of that money funds promising
2827 [practice] programs or practices described by Section 265.151(c)
2928 and evidence-informed programs or practices described by Section
3029 265.151(d).
3130 SECTION 3. The heading to Subchapter D, Chapter 265, Family
3231 Code, is amended to read as follows:

3534 SECTION 4. The heading to Section 265.151, Family Code, is
3635 amended to read as follows:
3736 Sec. 265.151. REQUIREMENTS FOR [PARENTING EDUCATION]
3837 PROGRAMS AND PRACTICES ON EVIDENCE-BASED SPECTRUM.
3938 SECTION 5. Section 265.151, Family Code, is amended by
4039 amending Subsections (b) and (c) and adding Subsection (d) to read
4140 as follows:
4241 (b) An evidence-based program or practice is a [parenting
4342 education] program or practice that:
4443 (1) is research-based and grounded in relevant,
4544 empirical knowledge and program-determined outcomes;
4645 (2) has comprehensive standards ensuring the highest
4746 quality service delivery with continuous improvement in the quality
4847 of service delivery;
4948 (3) has demonstrated significant positive [short-term
5049 and long-term] outcomes;
5150 (4) is listed as an evidence-based program or practice
5251 by a nationally recognized clearinghouse associated with a state or
5352 federal agency or an institution of higher education or, during the
5453 preceding 10 years, has been subject to an external evaluation that
5554 showed positive results and was published in peer-reviewed
5655 literature [has been evaluated by at least one rigorous, random,
5756 controlled research trial across heterogeneous populations or
5857 communities with research results that have been published in a
5958 peer-reviewed journal];
6059 (5) substantially complies with a program manual or
6160 design that specifies the purpose, outcomes, duration, and
6261 frequency of the program services; [and]
6362 (6) employs well-trained and competent staff and
6463 provides continual relevant professional development opportunities
6564 to the staff;
6665 (7) is associated with a national organization,
6766 institution of higher education, or national or state public health
6867 institute; and
6968 (8) demonstrates substantial connections to other
7069 community-based services.
7170 (c) A promising [practice] program or practice is a
7271 [parenting education] program or practice that:
7372 (1) has an active impact evaluation program or
7473 demonstrates a schedule for implementing an active impact
7574 evaluation program;
7675 (2) is listed as a promising program or practice by a
7776 nationally recognized clearinghouse associated with a state or
7877 federal agency or an institution of higher education or, during the
7978 preceding 10 years, has been subject to an external evaluation that
8079 showed positive results and was published in peer-reviewed
8180 literature [has been evaluated by at least one outcome-based study
8281 demonstrating effectiveness or random, controlled trial in a
8382 homogeneous sample];
8483 (3) substantially complies with a program manual or
8584 design that specifies the purpose, outcomes, duration, and
8685 frequency of the program services;
8786 (4) employs well-trained and competent staff and
8887 provides continual relevant professional development opportunities
8988 to the staff; [and]
9089 (5) is research-based and grounded in relevant,
9190 empirical knowledge and program-determined outcomes; and
9291 (6) demonstrates substantial connections to other
9392 community-based services.
9493 (d) An evidence-informed program or practice is a program or
9594 practice that:
9695 (1) combines well-researched interventions with
9796 clinical experience and ethics, and client preferences and culture,
9897 to guide and inform the delivery of treatments and services;
9998 (2) has an active impact evaluation program or
10099 demonstrates a schedule for implementing an active impact
101100 evaluation program;
102101 (3) substantially complies with a program manual or
103102 design that specifies the purpose, outcome, duration, and frequency
104103 of the program services; and
105104 (4) employs well-trained and competent staff and
106105 provides continual relevant professional development opportunities
107106 to the staff.
108107 SECTION 6. Section 265.152, Family Code, is amended to read
109108 as follows:
110109 Sec. 265.152. OUTCOMES OF EVIDENCE-BASED PREVENTION AND
111110 EARLY INTERVENTION PROGRAMS AND PRACTICES [PARENTING EDUCATION].
112111 The department shall ensure that a prevention and early
113112 intervention [parenting education] program or practice provided
114113 under this subchapter [chapter] achieves favorable behavioral
115114 outcomes in at least two of the following areas:
116115 (1) improved cognitive development of children;
117116 (2) increased [school] readiness for and
118117 participation and performance in school [of children];
119118 (3) reduced child abuse, neglect, and injury;
120119 (4) improved child safety;
121120 (5) improved social-emotional development of children
122121 and youth;
123122 (6) increased protective factors [improved parenting
124123 skills], including nurturing, [and] bonding, and other parenting
125124 skills;
126125 (7) improved family economic self-sufficiency;
127126 (8) reduced parental or youth involvement with the
128127 criminal justice system; [and]
129128 (9) increased paternal involvement and support;
130129 (10) improved maternal and child health; and
131130 (11) increased protective factors for youth.
132131 SECTION 7. Section 265.153, Family Code, is amended to read
133132 as follows:
134133 Sec. 265.153. EVALUATION OF PREVENTION AND EARLY
135134 INTERVENTION PROGRAMS AND PRACTICES [EVIDENCE-BASED PARENTING
136135 EDUCATION]. (a) The department shall adopt outcome indicators to
137136 measure the effectiveness of prevention and early intervention
138137 [parenting education] programs and practices provided under this
139138 subchapter [chapter] in achieving desired outcomes.
140139 (b) The department may work directly with the model
141140 developer of a prevention and early intervention [parenting
142141 education] program or practice to identify appropriate outcome
143142 indicators for the program or practice and to ensure that the
144143 program or practice substantially complies with the model.
145144 (c) The department shall develop internal processes to
146145 share information with prevention and early intervention service
147146 providers [parenting education programs] to assist the department
148147 in analyzing the performance of the programs or practices.
149148 (d) The department shall use information obtained under
150149 this section to:
151150 (1) monitor prevention and early intervention
152151 [parenting education] programs and practices;
153152 (2) continually improve the quality of the programs
154153 and practices; and
155154 (3) evaluate the effectiveness of the programs and
156155 practices.
157156 SECTION 8. Section 265.154, Family Code, is amended to read
158157 as follows:
159158 Sec. 265.154. REPORTS TO LEGISLATURE. (a) Not later than
160159 December 1 of each even-numbered year, the department shall prepare
161160 and submit a report on state-funded prevention and early
162161 intervention [parenting education] programs and practices to the
163162 standing committees of the senate and house of representatives with
164163 jurisdiction over child protective services.
165164 (b) A report submitted under this section must include:
166165 (1) a description of the prevention and early
167166 intervention [parenting education] programs and practices
168167 implemented and of the models associated with the programs and
169168 practices;
170169 (2) information on the families served by the programs
171170 and practices, including the number of families served and their
172171 demographic information;
173172 (3) the goals and achieved outcomes of the implemented
174173 programs and practices;
175174 (4) information on the cost for each family served,
176175 including any available third-party return-on-investment analysis;
177176 and
178177 (5) information explaining the percentage of money
179178 spent on evidence-based programs and practices, on promising
180179 [practice] programs and practices, and on evidence-informed
181180 programs and practices.
182181 SECTION 9. Section 265.151(a), Family Code, is repealed.
183182 SECTION 10. This Act takes effect September 1, 2019.
