| 7 | 7 | | relating to the eligibility for release on parole of certain |

| 8 | 8 | | inmates serving a sentence for the criminal offense of continuous |
|---|
| 9 | 9 | | trafficking of persons. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 508.145(a), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) An inmate under sentence of death, serving a sentence of |
|---|
| 14 | 14 | | life imprisonment without parole, serving a sentence for an offense |
|---|
| 15 | 15 | | under Section 20A.03, Penal Code, if the offense is based wholly on |
|---|
| 16 | 16 | | conduct that constitutes an offense under Section 20A.02(a)(5), |
|---|
| 17 | 17 | | (6), (7), or (8) of that code, serving a sentence for an offense |
|---|
| 18 | 18 | | under Section 21.02, Penal Code, or serving a sentence for an |
|---|
| 19 | 19 | | offense under Section 22.021, Penal Code, that is punishable under |
|---|
| 20 | 20 | | Subsection (f) of that section is not eligible for release on |
|---|
| 21 | 21 | | parole. |
|---|
| 22 | 22 | | SECTION 2. Section 508.145(d)(1), Government Code, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | (d)(1) This subsection applies only to an inmate who is |
|---|
| 25 | 25 | | serving a sentence for: |
|---|
| 26 | 26 | | (A) an offense described by Article 42A.054(a), |
|---|
| 27 | 27 | | Code of Criminal Procedure, other than an offense under Section |
|---|
| 28 | 28 | | 19.03, Penal Code; |
|---|
| 29 | 29 | | (B) an offense for which the judgment contains an |
|---|
| 30 | 30 | | affirmative finding under Article 42A.054(c) or (d), Code of |
|---|
| 31 | 31 | | Criminal Procedure; |
|---|
| 32 | 32 | | (C) an offense under Section 20A.03, Penal Code, |
|---|
| 33 | 33 | | if the offense is not wholly based on conduct that constitutes an |
|---|
| 34 | 34 | | offense under Section 20A.02(a)(5), (6), (7), or (8) of that code; |
|---|
| 35 | 35 | | or |
|---|
| 36 | 36 | | (D) an offense under Section 71.02 or 71.023, |
|---|
| 37 | 37 | | Penal Code. |
|---|
| 38 | 38 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 39 | 39 | | to an offense committed on or after the effective date of this Act. |
|---|
| 40 | 40 | | An offense committed before the effective date of this Act is |
|---|
| 41 | 41 | | governed by the law in effect on the date the offense was committed, |
|---|
| 42 | 42 | | and the former law is continued in effect for that purpose. For |
|---|
| 43 | 43 | | purposes of this section, an offense was committed before the |
|---|
| 44 | 44 | | effective date of this Act if any element of the offense occurred |
|---|
| 45 | 45 | | before that date. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect September 1, 2019. |
