55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility for release on parole of certain
88 inmates serving a sentence for the criminal offense of continuous
99 trafficking of persons.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 508.145(a), Government Code, is amended
1212 to read as follows:
1313 (a) An inmate under sentence of death, serving a sentence of
1414 life imprisonment without parole, serving a sentence for an offense
1515 under Section 20A.03, Penal Code, if the offense is based wholly on
1616 conduct that constitutes an offense under Section 20A.02(a)(5),
1717 (6), (7), or (8) of that code, serving a sentence for an offense
1818 under Section 21.02, Penal Code, or serving a sentence for an
1919 offense under Section 22.021, Penal Code, that is punishable under
2020 Subsection (f) of that section is not eligible for release on
2121 parole.
2222 SECTION 2. Section 508.145(d)(1), Government Code, is
2323 amended to read as follows:
2424 (d)(1) This subsection applies only to an inmate who is
2525 serving a sentence for:
2626 (A) an offense described by Article 42A.054(a),
2727 Code of Criminal Procedure, other than an offense under Section
2828 19.03, Penal Code;
2929 (B) an offense for which the judgment contains an
3030 affirmative finding under Article 42A.054(c) or (d), Code of
3131 Criminal Procedure;
3232 (C) an offense under Section 20A.03, Penal Code,
3333 if the offense is not wholly based on conduct that constitutes an
3434 offense under Section 20A.02(a)(5), (6), (7), or (8) of that code;
3535 or
3636 (D) an offense under Section 71.02 or 71.023,
3737 Penal Code.
3838 SECTION 3. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 4. This Act takes effect September 1, 2019.
