44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a Department of Family and Protective Services plan to
77 address the substitute care capacity needs in certain department
88 regions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.1261(b), Family Code, as added by
1111 Chapter 319 (S.B. 11), Acts of the 85th Legislature, Regular
1212 Session, 2017, is amended to read as follows:
1313 (b) Appropriate department management personnel from a
1414 child protective services region in which community-based care has
1515 not been implemented, in collaboration with foster care providers,
1616 faith-based entities, and child advocates in that region, shall use
1717 data collected by the department on foster care capacity needs and
1818 availability of each type of foster care and kinship placement in
1919 the region to create a plan to address the substitute care capacity
2020 needs in the region. The plan must identify:
2121 (1) [both] short-term and long-term goals and
2222 strategies for addressing those capacity needs; and
2323 (2) the capacity and geographic distribution of the
2424 following foster placements:
2525 (A) licensed residential family-based substance
2626 use treatment facilities;
2727 (B) qualified residential treatment programs as
2828 defined in the federal Family First Prevention Services Act (Title
2929 VII, Div. E, Pub. L. No. 115-123);
3030 (C) settings specializing in providing prenatal,
3131 post-partum, or parenting supports for youth;
3232 (D) supervised settings in which a child who has
3333 attained 18 years of age is living independently; and
3434 (E) settings providing high-quality residential
3535 care to children and youth who have been found to be, or are at risk
3636 of becoming, sex trafficking victims.
3737 SECTION 2. Sections 264.1261(a) and (b), Family Code, as
3838 added by Chapter 822 (H.B. 1549), Acts of the 85th Legislature,
3939 Regular Session, 2017, are repealed.
4040 SECTION 3. This Act takes effect September 1, 2019.
