44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to training for certain individuals who provide care for
77 or services to children in the conservatorship of the Department of
88 Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.015, Family Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) The department shall, in consultation with foster care
1313 alumni, Preparation for Adult Living staff, institutions of higher
1414 learning, and current foster youth, foster parents and adoptive
1515 parents, adopt or develop a training program for any foster
1616 parents, adoptive parents, or kinship caregivers regarding the most
1717 effective methods of communicating with children who are or have
1818 been in the conservatorship of the department about issues
1919 regarding health and well-being, including:
2020 (1) self-image;
2121 (2) healthy relationships;
2222 (3) goal setting;
2323 (4) planning and decision making; and
2424 (5) protection from sexually transmitted infections,
2525 unintended pregnancy, and exploitation.
2626 SECTION 2. Subchapter A, Chapter 264, Family Code, is
2727 amended by adding Section 264.0151 to read as follows:
2828 Sec. 264.0151. TRAINING MATERIALS FOR GUARDIANS AD LITEM,
2929 ATTORNEYS AD LITEM, COURT APPOINTED SPECIAL ADVOCATES AND JUDGES.
3030 The Supreme Court of Texas Permanent Judicial Commission for
3131 Children, Youth and Families shall, in consultation with
3232 stakeholders including, but not limited to, current guardians ad
3333 litem, attorneys ad litem, and court appointed special advocates,
3434 develop training materials for guardians ad litem, attorneys ad
3535 litem, and judges who represent or preside over cases involving
3636 children and youth in the conservatorship of the department
3737 concerning the health and well-being of those children and youth,
3838 including:
3939 (1) policies regarding consent for health care
4040 services, including reproductive health care, family planning, and
4141 contraceptive care;
4242 (2) general health and wellness;
4343 (3) healthy relationships; and
4444 (4) advocating for or representing pregnant and
4545 parenting children and youth.
4646 SECTION 3. Subchapter B, Chapter 40, Human Resources Code,
4747 is amended by adding Section 40.036 to read as follows:
4848 Sec. 40.036. CASEWORKER TRAINING ON HEALTHY RELATIONSHIPS.
4949 The department, in collaboration with an institute for higher
5050 learning, shall create or adopt a required training program for
5151 child protective services caseworkers to provide instruction to the
5252 caseworkers on developmentally-appropriate, trauma-informed
5353 methods of communicating with children in the managing
5454 conservatorship of the department regarding reproductive health
5555 and healthy relationships. The training must be informed by
5656 evidence-based or model curriculum and include content regarding:
5757 (1) minor consent to sexual activity, including the
5858 legal age for consent under state law;
5959 (2) minor consent to health care services including
6060 family planning or contraceptive services;
6161 (3) preserving confidentiality; and
6262 (4) providing services to a child who becomes pregnant
6363 or who is a minor parent.
6464 SECTION 4. This Act takes effect September 1, 2019.
