| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 38.001, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-1) to read as follows: |
|---|
| 12 | 12 | | (a-1) Each student shall be fully immunized against |
|---|
| 13 | 13 | | bacterial meningitis, except as provided by Subsection (c). To |
|---|
| 14 | 14 | | satisfy the requirement of this subsection, a student must show |
|---|
| 15 | 15 | | proof of a quadrivalent meningococcal conjugate vaccine and a |
|---|
| 16 | 16 | | booster dose of that vaccine in accordance with the recommended |
|---|
| 17 | 17 | | immunization schedule adopted by the Department of State Health |
|---|
| 18 | 18 | | Services, as well as any additional vaccine recommended for the |
|---|
| 19 | 19 | | prevention of bacterial meningitis by the federal Centers for |
|---|
| 20 | 20 | | Disease Control and Prevention. The executive commissioner of the |
|---|
| 21 | 21 | | Health and Human Services Commission shall adopt rules for the |
|---|
| 22 | 22 | | implementation of this subsection. |

| 23 | 23 | | SECTION 2. Not later than June 1, 2020, the executive |
|---|
| 24 | 24 | | commissioner of the Health and Human Services Commission shall |
|---|
| 25 | 25 | | adopt the rules necessary to implement Section 38.001(a-1), |
|---|
| 26 | 26 | | Education Code, as added by this Act. |
|---|
| 27 | 27 | | SECTION 3. Section 38.001(a-1), Education Code, as added by |
|---|
| 28 | 28 | | this Act, applies beginning with the 2020-2021 school year. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect September 1, 2019. |
