65 AN ACT
76 relating to the adoption of uniform general conditions for building
87 construction contracts entered into by school districts and the
98 composition of the committee that reviews uniform general
109 conditions.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subchapter B, Chapter 44, Education Code, is
1312 amended by adding Section 44.035 to read as follows:
1413 Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR
1514 SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. After reviewing
1615 the uniform general conditions adopted by the Texas Facilities
1716 Commission under Section 2166.302, Government Code, a school
1817 district may adopt uniform general conditions to be incorporated in
1918 all district building construction contracts.
2019 SECTION 2. Section 2166.305(b), Government Code, is amended
2120 to read as follows:
2221 (b) A committee appointed by the commission shall perform
2322 the review. The committee consists of:
2423 (1) the director of facilities construction and space
2524 management appointed under Section 2152.104, who serves as the
2625 presiding officer of the committee;
2726 (2) six individuals appointed by the commission, one
2827 each from the lists of nominees submitted respectively by the:
2928 (A) president of the Texas Society of Architects;
3029 (B) president of the Texas Society of
3130 Professional Engineers;
3231 (C) presiding officer of the Executive Council of
3332 the Texas Associated General Contractors Chapters;
3433 (D) executive secretary of the Mechanical
3534 Contractors Associations of Texas, Incorporated;
3635 (E) executive secretary of the Texas Building and
3736 Construction Trades Council; and
3837 (F) president of the Associated Builders and
3938 Contractors of Texas;
4039 (3) one individual appointed by the commission
4140 representing an institution of higher education, as defined by
4241 Section 61.003, Education Code;
4342 (4) one individual appointed by the commission
4443 representing a state agency that has a substantial ongoing
4544 construction program;
4645 (5) one individual appointed by the commission
4746 representing the attorney general's office;
4847 (6) one individual appointed by the commission
4948 representing the interests of historically underutilized
5049 businesses; [and]
5150 (7) two individuals appointed by the commission, each
5251 representing a different minority contractors association;
5352 (8) one individual appointed by the commission
5453 representing the Texas Association of School Boards; and
5554 (9) one individual appointed by the commission
5655 representing the Texas Association of School Administrators.
5756 SECTION 3. Not later than December 1, 2019, the Texas
5857 Facilities Commission shall appoint two additional members to the
5958 committee in accordance with Section 2166.305(b), Government Code,
6059 as amended by this Act.
6160 SECTION 4. This Act takes effect immediately if it receives
6261 a vote of two-thirds of all the members elected to each house, as
6362 provided by Section 39, Article III, Texas Constitution. If this
6463 Act does not receive the vote necessary for immediate effect, this
6564 Act takes effect September 1, 2019.
