11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 11 | | SECTION 1. Subchapter B, Chapter 44, Education Code, is |
---|
13 | 12 | | amended by adding Section 44.035 to read as follows: |
---|
14 | 13 | | Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR |
---|
15 | 14 | | SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. After reviewing |
---|
16 | 15 | | the uniform general conditions adopted by the Texas Facilities |
---|
17 | 16 | | Commission under Section 2166.302, Government Code, a school |
---|
18 | 17 | | district may adopt uniform general conditions to be incorporated in |
---|
19 | 18 | | all district building construction contracts. |
---|
20 | 19 | | SECTION 2. Section 2166.305(b), Government Code, is amended |
---|
21 | 20 | | to read as follows: |
---|
22 | 21 | | (b) A committee appointed by the commission shall perform |
---|
23 | 22 | | the review. The committee consists of: |
---|
24 | 23 | | (1) the director of facilities construction and space |
---|
25 | 24 | | management appointed under Section 2152.104, who serves as the |
---|
26 | 25 | | presiding officer of the committee; |
---|
27 | 26 | | (2) six individuals appointed by the commission, one |
---|
28 | 27 | | each from the lists of nominees submitted respectively by the: |
---|
29 | 28 | | (A) president of the Texas Society of Architects; |
---|
30 | 29 | | (B) president of the Texas Society of |
---|
31 | 30 | | Professional Engineers; |
---|
32 | 31 | | (C) presiding officer of the Executive Council of |
---|
33 | 32 | | the Texas Associated General Contractors Chapters; |
---|
34 | 33 | | (D) executive secretary of the Mechanical |
---|
35 | 34 | | Contractors Associations of Texas, Incorporated; |
---|
36 | 35 | | (E) executive secretary of the Texas Building and |
---|
37 | 36 | | Construction Trades Council; and |
---|
38 | 37 | | (F) president of the Associated Builders and |
---|
39 | 38 | | Contractors of Texas; |
---|
40 | 39 | | (3) one individual appointed by the commission |
---|
41 | 40 | | representing an institution of higher education, as defined by |
---|
42 | 41 | | Section 61.003, Education Code; |
---|
43 | 42 | | (4) one individual appointed by the commission |
---|
44 | 43 | | representing a state agency that has a substantial ongoing |
---|
45 | 44 | | construction program; |
---|
46 | 45 | | (5) one individual appointed by the commission |
---|
47 | 46 | | representing the attorney general's office; |
---|
48 | 47 | | (6) one individual appointed by the commission |
---|
49 | 48 | | representing the interests of historically underutilized |
---|
50 | 49 | | businesses; [and] |
---|
51 | 50 | | (7) two individuals appointed by the commission, each |
---|
52 | 51 | | representing a different minority contractors association; |
---|
53 | 52 | | (8) one individual appointed by the commission |
---|
54 | 53 | | representing the Texas Association of School Boards; and |
---|
55 | 54 | | (9) one individual appointed by the commission |
---|
56 | 55 | | representing the Texas Association of School Administrators. |
---|
57 | 56 | | SECTION 3. Not later than December 1, 2019, the Texas |
---|
58 | 57 | | Facilities Commission shall appoint two additional members to the |
---|
59 | 58 | | committee in accordance with Section 2166.305(b), Government Code, |
---|
60 | 59 | | as amended by this Act. |
---|
61 | 60 | | SECTION 4. This Act takes effect immediately if it receives |
---|
62 | 61 | | a vote of two-thirds of all the members elected to each house, as |
---|
63 | 62 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
64 | 63 | | Act does not receive the vote necessary for immediate effect, this |
---|
65 | 64 | | Act takes effect September 1, 2019. |
