46 AN ACT
57 relating to the electronic transmission of an invoice or notice of
68 toll nonpayment by a toll project entity.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter C, Chapter 284, Transportation Code,
911 is amended by adding Section 284.0703 to read as follows:
1012 Sec. 284.0703. METHOD OF SENDING INVOICE OR NOTICE. As
1113 authorized under Section 322.008(d)(2), Business & Commerce Code, a
1214 county may provide an invoice or notice required under this chapter
1315 to be sent by first class mail instead as an electronic record:
1416 (1) if the recipient of the information agrees to the
1517 transmission of the information as an electronic record; and
1618 (2) on terms acceptable to the recipient.
1719 SECTION 2. Section 370.177, Transportation Code, is amended
1820 by adding Subsection (n) to read as follows:
1921 (n) As authorized under Section 322.008(d)(2), Business &
2022 Commerce Code, an authority may provide an invoice or notice
2123 required under this section to be sent by first class mail instead
2224 as an electronic record:
2325 (1) if the recipient of the information agrees to the
2426 transmission of the information as an electronic record; and
2527 (2) on terms acceptable to the recipient.
2628 SECTION 3. Subchapter C, Chapter 372, Transportation Code,
2729 is amended by adding Section 372.116 to read as follows:
2830 Sec. 372.116. METHOD OF SENDING INVOICE OR NOTICE. As
2931 authorized under Section 322.008(d)(2), Business & Commerce Code, a
3032 toll project entity may provide an invoice or notice required under
3133 this subchapter to be sent by first class mail instead as an
3234 electronic record:
3335 (1) if the recipient of the information agrees to the
3436 transmission of the information as an electronic record; and
3537 (2) on terms acceptable to the recipient.
3638 SECTION 4. The change in law made by this Act applies only
3739 to the collection of a toll incurred on or after the effective date
3840 of this Act. The collection of a toll incurred before the effective
3941 date of this Act is governed by the law in effect immediately before
4042 the effective date of this Act, and that law is continued in effect
4143 for that purpose.
4244 SECTION 5. This Act takes effect September 1, 2019.
