65 AN ACT
76 relating to demonstration programs for childhood obesity and
87 chronic disease prevention in certain border counties.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
1110 amended by adding Chapter 90 to read as follows:
1211 CHAPTER 90. DEMONSTRATION PROGRAMS ADDRESSING CHILDHOOD OBESITY
1312 AND CHRONIC DISEASE IN CERTAIN BORDER COUNTIES
1413 Sec. 90.0001. DEFINITION. In this chapter, "border county"
1514 means a county adjacent to this state's international border with
1615 Mexico.
1716 Sec. 90.0002. ESTABLISHMENT. The department shall
1817 establish the childhood obesity prevention demonstration program
1918 and the chronic disease prevention demonstration program under this
2019 chapter in counties that:
2120 (1) are adjacent to the international border with
2221 Mexico; and
2322 (2) have a population of less than 800,000 and more
2423 than 400,000.
2524 Sec. 90.0003. CHILDHOOD OBESITY PREVENTION DEMONSTRATION
2625 PROGRAM. (a) To the extent funds are available, the department
2726 shall develop and implement a school-based demonstration program to
2827 address childhood obesity and related chronic diseases in each
2928 county to which this chapter applies.
3029 (b) The demonstration program must be evidence-based and
3130 culturally appropriate.
3231 (c) In developing the childhood obesity prevention
3332 demonstration program under Subsection (a), the department shall
3433 prioritize appropriate collaborations with:
3534 (1) medical professionals specializing in obesity
3635 prevention;
3736 (2) experts in public health;
3837 (3) representatives of health science centers;
3938 (4) experts in public and higher education;
4039 (5) representatives of local school health advisory
4140 councils;
4241 (6) interested parties from the counties
4342 participating in the program;
4443 (7) a representative from the Texas Education Agency;
4544 (8) a representative from the Texas Higher Education
4645 Coordinating Board; and
4746 (9) representatives from other appropriate state
4847 agencies.
4948 Sec. 90.0004. CHRONIC DISEASE PREVENTION DEMONSTRATION
5049 PROGRAM. (a) To the extent funds are available, the department
5150 shall establish a chronic disease prevention demonstration program
5251 for adults residing in each county to which this chapter applies.
5352 (b) In establishing the chronic disease prevention
5453 demonstration program under Subsection (a), the department shall
5554 prioritize appropriate collaboration with:
5655 (1) medical professionals specializing in chronic
5756 disease treatment;
5857 (2) representatives from hospitals licensed under
5958 Chapter 241;
6059 (3) representatives from academic centers located in
6160 border counties; and
6261 (4) a representative from a medical school in the
6362 immediate border region.
6463 Sec. 90.0005. RECOMMENDATIONS FOR SCHOOLS AND OTHER
6564 ENTITIES. The department, based on the results of the
6665 demonstration programs established under this chapter, shall share
6766 the strategies, best practices, and recommendations the department
6867 determines are successful in addressing childhood obesity and
6968 chronic disease prevention with public schools and other
7069 appropriate entities in each county to which this chapter applies.
7170 Sec. 90.0006. EVALUATION. The department shall evaluate
7271 the effectiveness of the demonstration programs established under
7372 this chapter not later than September 1, 2029.
7473 Sec. 90.0007. REPORT. Not later than November 1, 2029, the
7574 department shall submit a written or electronic report on the
7675 demonstration programs established under this chapter to the
7776 lieutenant governor, the speaker of the house of representatives,
7877 and each member of the legislature. The report must include:
7978 (1) a summary of the programs;
8079 (2) an evaluation of the effectiveness of the
8180 programs; and
8281 (3) recommendations on whether the programs should be
8382 continued, expanded to other border counties, or terminated.
8483 Sec. 90.0008. RULES. The executive commissioner shall
8584 adopt rules as necessary to implement this chapter.
8685 SECTION 2. The Department of State Health Services is
8786 required to implement a provision of this Act only if the
8887 legislature appropriates money specifically for that purpose. If
8988 the legislature does not appropriate money specifically for that
9089 purpose, the department may, but is not required to, implement a
9190 provision of this Act using other appropriations available for that
9291 purpose.
9392 SECTION 3. This Act takes effect September 1, 2019.
