| 7 | 7 | | relating to zero-based budgeting for state agencies as part of the |

| 8 | 8 | | sunset review process. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 325.007, Government Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 325.007. AGENCY REPORT TO COMMISSION; ZERO-BASED |
|---|
| 13 | 13 | | BUDGET. |
|---|
| 14 | 14 | | SECTION 2. Section 325.007, Government Code, is amended by |
|---|
| 15 | 15 | | adding Subsections (c) and (d) to read as follows: |
|---|
| 16 | 16 | | (c) Before November 1 of the odd-numbered year before the |
|---|
| 17 | 17 | | year in which a state agency subject to this chapter is to be |
|---|
| 18 | 18 | | abolished, the agency shall present to the commission a zero-based |
|---|
| 19 | 19 | | budget for the state fiscal biennium that begins on the date the |
|---|
| 20 | 20 | | agency is scheduled to be abolished that contains: |
|---|
| 21 | 21 | | (1) a description of the discrete activities the |
|---|
| 22 | 22 | | agency is charged with conducting or performing, together with a |
|---|
| 23 | 23 | | justification for each activity by reference to a statute or other |
|---|
| 24 | 24 | | legal authority; |
|---|
| 25 | 25 | | (2) for each activity identified under Subdivision |
|---|
| 26 | 26 | | (1): |
|---|
| 27 | 27 | | (A) a quantitative estimate of any adverse |
|---|
| 28 | 28 | | effects that reasonably may be expected to result if the activity |
|---|
| 29 | 29 | | were discontinued, together with a description of the methods by |
|---|
| 30 | 30 | | which the adverse effects were estimated; |
|---|
| 31 | 31 | | (B) an itemized account of expenditures required |
|---|
| 32 | 32 | | to maintain the activity at the minimum level of service or |
|---|
| 33 | 33 | | performance required by the statute or other legal authority, |
|---|
| 34 | 34 | | together with a concise statement of the quantity and quality of |
|---|
| 35 | 35 | | service or performance required at that minimum level; and |
|---|
| 36 | 36 | | (C) an itemized account of expenditures required |
|---|
| 37 | 37 | | to maintain the activity at the current level of service or |
|---|
| 38 | 38 | | performance, together with a concise statement of the quantity and |
|---|
| 39 | 39 | | quality of service or performance provided at that current level; |
|---|
| 40 | 40 | | and |
|---|
| 41 | 41 | | (3) a ranking of activities identified under |
|---|
| 42 | 42 | | Subdivision (1) that illustrates the relative importance of each |
|---|
| 43 | 43 | | activity to the overall goals and purposes of the agency at current |
|---|
| 44 | 44 | | service or performance levels. |
|---|
| 45 | 45 | | (d) A state agency shall submit the zero-based budget |
|---|
| 46 | 46 | | required under Subsection (c) to the Legislative Budget Board as |
|---|
| 47 | 47 | | part of the agency's legislative appropriations request for the |
|---|
| 48 | 48 | | state fiscal biennium that begins on the date the agency is |
|---|
| 49 | 49 | | scheduled to be abolished. |
|---|
| 50 | 50 | | SECTION 3. The changes in law made by this Act apply in |
|---|
| 51 | 51 | | relation to the review by the Sunset Advisory Commission of |
|---|
| 52 | 52 | | agencies scheduled to be abolished on or after September 1, 2023, if |
|---|
| 53 | 53 | | not continued in accordance with Chapter 325, Government Code, and |
|---|
| 54 | 54 | | in relation to any other agencies that by law are reviewed during |
|---|
| 55 | 55 | | those review periods by the Sunset Advisory Commission. |
|---|
| 56 | 56 | | SECTION 4. This Act takes effect September 1, 2019. |
