66 AN ACT
77 relating to the availability of dates of birth under the public
88 information law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 552, Government Code, is
1111 amended by adding Section 552.0222 to read as follows:
1212 Sec. 552.0222. DATES OF BIRTH. Notwithstanding Section
1313 552.101, this chapter does not authorize a governmental body to
1414 withhold a date of birth except as:
1515 (1) permitted by Section 552.102; or
1616 (2) otherwise provided by constitutional or statutory
1717 law.
1818 SECTION 2. The changes in law made by this Act apply only to
1919 a request for information that is received by a governmental body or
2020 an officer for public information on or after the effective date of
2121 this Act. A request for information that was received before the
2222 effective date of this Act is governed by the law in effect on the
2323 date the request was received, and the former law is continued in
2424 effect for that purpose.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
