| 7 | 7 | | relating to a school district partnering with certain eligible |

| 8 | 8 | | entities to operate a district campus. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 11.174(c) and (h), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) Before entering into a contract as provided by this |
|---|
| 13 | 13 | | section, a school district must consult with campus personnel |
|---|
| 14 | 14 | | regarding the provisions to be included in the contract between the |
|---|
| 15 | 15 | | school district and the open-enrollment charter school or the |
|---|
| 16 | 16 | | entity. All rights and protections afforded by current employment |
|---|
| 17 | 17 | | contracts or agreements may not be affected by the contract entered |
|---|
| 18 | 18 | | into between a school district and an open-enrollment charter |
|---|
| 19 | 19 | | school or an entity under this section. |
|---|
| 20 | 20 | | (h) Subject to Subsection (i), a contract entered into by |
|---|
| 21 | 21 | | the board of trustees of a school district and the governing body of |
|---|
| 22 | 22 | | an open-enrollment charter school or the entity for the operation |
|---|
| 23 | 23 | | of a district campus as provided by Subsection (a) must include a |
|---|
| 24 | 24 | | provision addressing student eligibility for enrollment. |
|---|
| 25 | 25 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 26 | 26 | | school year. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2019. |
