66 AN ACT
77 relating to paid leave for a state employee who is a search and
88 rescue volunteer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 661.905, Government Code, is amended to
1111 read as follows:
1212 Sec. 661.905. VOLUNTEER FIREFIGHTERS, [AND] EMERGENCY
1313 MEDICAL SERVICES VOLUNTEERS, AND SEARCH AND RESCUE VOLUNTEERS. (a)
1414 In this section:
1515 (1) "Emergency[, "emergency] medical services
1616 volunteer" has the meaning assigned by Section 773.003, Health and
1717 Safety Code.
1818 (2) "Search and rescue volunteer" means an individual
1919 who without remuneration, except reimbursement for expenses,
2020 provides services for or on behalf of an organization that conducts
2121 search and rescue activities.
2222 (b) A state employee who is a volunteer firefighter, [or] an
2323 emergency medical services volunteer, or a search and rescue
2424 volunteer is entitled to a leave of absence without a deduction in
2525 salary to attend fire service, [or] emergency medical services, or
2626 search and rescue training conducted by a state agency or
2727 institution of higher education. Leave without a deduction in
2828 salary under this subsection may not exceed five working days in a
2929 fiscal year.
3030 (c) A state agency or institution of higher education may
3131 grant leave without a deduction in salary to a volunteer
3232 firefighter, [or] an emergency medical services volunteer, or a
3333 search and rescue volunteer for the purpose of allowing the
3434 firefighter, [or] emergency medical services volunteer, or search
3535 and rescue volunteer to respond to emergency fire, [or] medical, or
3636 search and rescue situations if the agency or institution has an
3737 established policy for granting that leave.
3838 SECTION 2. This Act takes effect September 1, 2019.
