5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to compensation and leave for certain employees of the
8	8	fraud unit of the Texas Department of Insurance.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 659.301(5), Government Code, is amended
11	11	to read as follows:
12	12	(5) "State employee" means an individual who:
13	13	(A) is a commissioned law enforcement officer of
14	14	the Department of Public Safety, the Texas Facilities Commission,
15	15	the Texas Alcoholic Beverage Commission, the Texas Department of
16	16	Criminal Justice, [or] the attorney general, or the insurance fraud
17	17	unit of the Texas Department of Insurance;
18	18	(B) is a commissioned security officer of the
19	19	comptroller;
20	20	(C) is a law enforcement officer commissioned by
21	21	the Parks and Wildlife Commission;
22	22	(D) is a commissioned peace officer of an
23	23	institution of higher education;
24	24	(E) is an employee or official of the Board of
25	25	Pardons and Paroles or the parole division of the Texas Department
26	26	of Criminal Justice if the employee or official has routine direct
27	27	contact with inmates of any penal or correctional institution or
28	28	with administratively released prisoners subject to the board's
29	29	jurisdiction;
30	30	(F) has been certified to the Employees
31	31	Retirement System of Texas under Section 815.505 as having begun
32	32	employment as a law enforcement officer or custodial officer,
33	33	unless the individual has been certified to the system as having
34	34	ceased employment as a law enforcement officer or custodial
35	35	officer; or
36	36	(G) before May 29, 1987, received hazardous duty
37	37	pay based on the terms of any state law if the individual holds a
38	38	position designated under that law as eligible for the pay.
39	39	SECTION 2. Section 661.918(a), Government Code, is amended
40	40	to read as follows:
41	41	(a) This section applies to a peace officer under Article
42	42	2.12, Code of Criminal Procedure, who is commissioned as a law
43	43	enforcement officer or agent, including a ranger, by:
44	44	(1) the Public Safety Commission and the director of
45	45	the Department of Public Safety;
46	46	(2) the Parks and Wildlife Commission;
47	47	(3) the Texas Alcoholic Beverage Commission; [or]
48	48	(4) the attorney general; or
49	49	(5) the insurance fraud unit of the Texas Department
50	50	of Insurance.
51	51	SECTION 3. Section 701.104, Insurance Code, is amended by
52	52	adding Subsection (d) to read as follows:
53	53	(d) The commissioner shall ensure that a peace officer
54	54	commissioned under Subsection (a) is compensated according to
55	55	Schedule C of the position classification salary schedule
56	56	prescribed by the General Appropriations Act.
57	57	SECTION 4. (a) The classification officer in the office of
58	58	the state auditor shall classify the position of commissioned peace
59	59	officer employed by the insurance fraud unit of the Texas
60	60	Department of Insurance as a Schedule C position under the Texas
61	61	Position Classification Plan.
62	62	(b) The change made by the classification officer as
63	63	required by this section applies beginning with the state fiscal
64	64	biennium beginning September 1, 2019.
65	65	(c) This section expires September 1, 2021.
66	66	SECTION 5. Section 661.918(a), Government Code, as amended
67	67	by this Act, applies only to an injury that occurs on or after the
68	68	effective date of this Act.
69	69	SECTION 6. This Act takes effect September 1, 2019.
