9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. Section 545.157(a), Transportation Code, is |
---|
11 | 10 | | amended to read as follows: |
---|
12 | 11 | | (a) This section applies only to the following vehicles: |
---|
13 | 12 | | (1) a stationary authorized emergency vehicle using |
---|
14 | 13 | | visual signals that meet the requirements of Sections 547.305 and |
---|
15 | 14 | | 547.702; |
---|
16 | 15 | | (2) a stationary tow truck using equipment authorized |
---|
17 | 16 | | by Section 547.305(d); [and] |
---|
18 | 17 | | (3) a Texas Department of Transportation vehicle or a |
---|
19 | 18 | | highway maintenance or construction vehicle operated pursuant to a |
---|
20 | 19 | | contract awarded under Subchapter A, Chapter 223, not separated |
---|
21 | 20 | | from the roadway by a traffic control channelizing device and using |
---|
22 | 21 | | visual signals that comply with the standards and specifications |
---|
23 | 22 | | adopted under Section 547.105; |
---|
24 | 23 | | (4) a service vehicle used by or for a utility, as |
---|
25 | 24 | | defined by Section 203.091, and using visual signals that comply |
---|
26 | 25 | | with the standards and specifications adopted under Section |
---|
27 | 26 | | 547.105; and |
---|
28 | 27 | | (5) a stationary vehicle used exclusively to transport |
---|
29 | 28 | | municipal solid waste, as defined by Section 361.003, Health and |
---|
30 | 29 | | Safety Code, or recyclable material, as defined by Section 361.421, |
---|
31 | 30 | | Health and Safety Code, while being operated in connection with the |
---|
32 | 31 | | removal or transportation of municipal solid waste or recyclable |
---|
33 | 32 | | material from a location adjacent to the highway. |
---|
34 | 33 | | SECTION 2. Section 547.001(2-b), Transportation Code, is |
---|
35 | 34 | | amended to read as follows: |
---|
36 | 35 | | (2-b) "Highway maintenance or construction vehicle" |
---|
37 | 36 | | means a highway or traffic maintenance or construction vehicle |
---|
38 | 37 | | designated by the Texas Department of Transportation. The term |
---|
39 | 38 | | includes equipment for: |
---|
40 | 39 | | (A) road maintenance or construction, including: |
---|
41 | 40 | | (i) equipment for snow removal, line |
---|
42 | 41 | | striping, skid resistance testing, sweeping, [and] spraying, |
---|
43 | 42 | | guardrail repair, sign maintenance, and temporary traffic-control |
---|
44 | 43 | | device placement or removal; |
---|
45 | 44 | | (ii) aerial platform lift machines; and |
---|
46 | 45 | | (iii) road profiler machines; and |
---|
47 | 46 | | (B) road construction or off-road use, including |
---|
48 | 47 | | motor graders, road rollers, excavators, pneumatic tire equipment, |
---|
49 | 48 | | movers, and tractors. |
---|
50 | 49 | | SECTION 3. The heading to Section 547.105, Transportation |
---|
51 | 50 | | Code, is amended to read as follows: |
---|
52 | 51 | | Sec. 547.105. [MAINTENANCE AND SERVICE VEHICLE] LIGHTING |
---|
53 | 52 | | STANDARDS FOR CERTAIN VEHICLES. |
---|
54 | 53 | | SECTION 4. Sections 547.105(a) and (b), Transportation |
---|
55 | 54 | | Code, are amended to read as follows: |
---|
56 | 55 | | (a) The Texas Department of Transportation shall adopt |
---|
57 | 56 | | standards and specifications that: |
---|
58 | 57 | | (1) apply to lamps on highway maintenance or |
---|
59 | 58 | | construction vehicles and service vehicles; and |
---|
60 | 59 | | (2) correlate with and conform as closely as possible |
---|
61 | 60 | | to standards and specifications approved by the American |
---|
62 | 61 | | Association of State Highway and Transportation Officials. |
---|
63 | 62 | | (b) The Texas Department of Transportation may adopt |
---|
64 | 63 | | standards and specifications for lighting that permit the use of |
---|
65 | 64 | | flashing lights for identification purposes on highway maintenance |
---|
66 | 65 | | or construction vehicles and service vehicles. |
---|
67 | 66 | | SECTION 5. Section 547.305(e), Transportation Code, is |
---|
68 | 67 | | amended to read as follows: |
---|
69 | 68 | | (e) A person may not operate a highway maintenance or |
---|
70 | 69 | | construction vehicle or service vehicle that is not equipped with |
---|
71 | 70 | | lamps or that does not display lighted lamps as required by the |
---|
72 | 71 | | standards and specifications adopted by the Texas Department of |
---|
73 | 72 | | Transportation. |
---|
74 | 73 | | SECTION 6. As soon as practicable after the effective date |
---|
75 | 74 | | of this Act, the Texas Department of Transportation shall adopt |
---|
76 | 75 | | standards and specifications relating to lamps and lighting on |
---|
77 | 76 | | highway construction vehicles, as required by Section 547.105, |
---|
78 | 77 | | Transportation Code, as amended by this Act. |
---|
79 | 78 | | SECTION 7. This Act takes effect September 1, 2019. |
