66 AN ACT
77 relating to the authority of a warehouse to store and ship wine.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.34(a), Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 (a) An applicant for a wholesaler's, class B wholesaler's,
1212 distiller's and rectifier's, brewer's, or winery permit may
1313 consolidate in a single application an [his] application for that
1414 permit and an [his] application for:
1515 (1) private storage;
1616 (2) storage in a [public bonded] warehouse under
1717 Chapter 46;
1818 (3) a private carrier's permit; and
1919 (4) any other permit the applicant [he] is qualified
2020 to receive.
2121 SECTION 2. Section 45.01, Alcoholic Beverage Code, is
2222 amended to read as follows:
2323 Sec. 45.01. AUTHORIZED ACTIVITIES. The holder of a storage
2424 permit may store liquor in a [public bonded] warehouse for which a
2525 permit has been issued under Chapter 46 or in a private warehouse
2626 owned or leased by the holder and operated by the holder.
2727 SECTION 3. Sections 45.03(a) and (c), Alcoholic Beverage
2828 Code, are amended to read as follows:
2929 (a) A storage permit may be issued to a holder of a brewer's,
3030 distiller's and rectifier's, winery, wholesaler's, class B
3131 wholesaler's, [or] wine bottler's, or out-of-state winery direct
3232 shipper's permit.
3333 (c) Except as provided by this subsection, a storage permit
3434 may not be issued for a location outside the county in which the
3535 permittee's business is located. Subject to Section 45.04, the
3636 holder of a winery permit or out-of-state winery direct shipper's
3737 permit may obtain a storage permit for a location inside or outside
3838 the county in which the permit holder's business is located.
3939 SECTION 4. Chapter 46, Alcoholic Beverage Code, is amended
4040 to read as follows:
4141 CHAPTER 46. [BONDED] WAREHOUSE PERMIT
4242 Sec. 46.01. AUTHORIZED ACTIVITIES. (a) The holder of a
4343 [bonded] warehouse permit may:
4444 (1) store liquor for any permittee who holds a permit
4545 authorizing [its] storage of liquor in a [public bonded] warehouse
4646 under this chapter; and
4747 (2) deliver wine to ultimate consumers in fulfillment
4848 of an order placed with the holder of a winery or out-of-state
4949 winery direct shipper's permit whose wine is held in the warehouse.
5050 (b) Delivery of wine under Subsection (a) must be by the
5151 holder of a carrier permit and comply with the provisions of Section
5252 16.09 or Chapter 54, as applicable.
5353 Sec. 46.02. FEE. The annual state fee for a [bonded]
5454 warehouse permit is $150.
5555 Sec. 46.03. QUALIFICATIONS FOR PERMIT. (a) Except as
5656 provided by Subsection (b), a [A bonded] warehouse permit may be
5757 issued to any [public bonded] warehouse that [:
5858 [(1) derives at least 50 percent of its gross revenue
5959 in a bona fide manner during each three-month period from the
6060 storage of goods or merchandise other than liquor; and
6161 [(2)] is not located in a dry area.
6262 (b) A [bonded] warehouse permit may be issued to a [public
6363 bonded] warehouse [described by Subsection (a)(1) of this section]
6464 that is located in a dry area only for the storage of the wine of the
6565 holder of a winery permit [who holds a permit authorizing its
6666 storage in a public bonded warehouse].
6767 Sec. 46.04. STORAGE INFORMATION. The holder of a [bonded]
6868 warehouse permit shall furnish [such] information concerning the
6969 liquor stored in and withdrawn from the warehouse as may be required
7070 by the commission.
7171 SECTION 5. Section 54.01, Alcoholic Beverage Code, is
7272 amended to read as follows:
7373 Sec. 54.01. AUTHORIZED ACTIVITIES. (a) The holder of an
7474 out-of-state winery direct shipper's permit may sell and deliver
7575 wine that is produced or bottled by the permittee to an ultimate
7676 consumer located in the State of Texas. Delivery must be by the
7777 holder of a carrier permit.
7878 (b) The holder of an out-of-state winery direct shipper's
7979 permit may store wine only in a warehouse for which a permit has
8080 been issued under Chapter 46.
8181 SECTION 6. This Act takes effect September 1, 2019.
