66 AN ACT
77 relating to sexual assault and domestic violence awareness
88 continuing education for cosmetology license holders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1602.354, Occupations Code, is amended
1111 by amending Subsection (c) and adding Subsections (d) and (e) to
1212 read as follows:
1313 (c) The commission shall require continuing education
1414 programs under this chapter to include information on:
1515 (1) activities commonly associated with human
1616 trafficking;
1717 (2) recognition of potential victims of human
1818 trafficking; [and]
1919 (3) methods for assisting victims of human
2020 trafficking, including how to report human trafficking; and
2121 (4) sexual assault and domestic violence awareness.
2222 (d) A license holder subject to Subsection (a) who is also a
2323 peace officer licensed under Chapter 1701, or an educator certified
2424 under Subchapter B, Chapter 21, Education Code, is exempt from the
2525 portion of continuing education described by Subsection (c)(4).
2626 (e) The commission may waive the requirement that a license
2727 holder participate in the portion of continuing education described
2828 by Subsection (c)(4) if:
2929 (1) the commission determines that completion of the
3030 requirement will cause the person substantial financial hardship;
3131 (2) the person is serving in the United States armed
3232 forces; or
3333 (3) the person is incapacitated due to illness.
3434 SECTION 2. Subchapter I, Chapter 1602, Occupations Code, is
3535 amended by adding Section 1602.409 to read as follows:
3636 Sec. 1602.409. IMMUNITY FROM LIABILITY. A person who has
3737 completed the portion of continuing education described by Section
3838 1602.354(c)(4), or that person's employer, is immune from civil and
3939 criminal liability for reporting, in good faith, information
4040 obtained during the course and scope of the person's employment
4141 that relates to a potential act of sexual assault or domestic
4242 violence.
4343 SECTION 3. (a) Not later than March 1, 2020, the Texas
4444 Commission of Licensing and Regulation shall adopt rules to
4545 implement Section 1602.354, Occupations Code, as amended by this
4646 Act.
4747 (b) Section 1602.354, Occupations Code, as amended by this
4848 Act, applies only to the renewal of a license or certificate that
4949 expires on or after September 1, 2020. The renewal of a license or
5050 certificate that expires before that date is governed by the law in
5151 effect immediately before the effective date of this Act, and the
5252 former law is continued in effect for that purpose.
5353 SECTION 4. This Act takes effect September 1, 2019.
