85 AN ACT
96 relating to suicide prevention in public school curriculum and
107 certain educational programs concerning suicide prevention and
118 substance abuse prevention.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 21.451(d), Education Code, is amended to
1411 read as follows:
1512 (d) The staff development:
1613 (1) may include training in:
1714 (A) technology;
1815 (B) conflict resolution;
1916 (C) discipline strategies, including classroom
2017 management, district discipline policies, and the student code of
2118 conduct adopted under Section 37.001 and Chapter 37;
2219 (D) preventing, identifying, responding to, and
2320 reporting incidents of bullying; and
2421 (E) digital learning;
2522 (2) subject to Subsection (e) and to Section 21.3541
2623 and rules adopted under that section, must include training that is
2724 evidence-based, as defined by Section 8101, Every Student Succeeds
2825 Act (20 U.S.C. Section 7801), that:
2926 (A) relates to instruction of students with
3027 disabilities; and
3128 (B) is designed for educators who work primarily
3229 outside the area of special education; and
3330 (3) must include suicide prevention training that must
3431 be provided:
3532 (A) on an annual basis, as part of a new employee
3633 orientation, to all new school district and open-enrollment charter
3734 school educators; and
3835 (B) to existing school district and
3936 open-enrollment charter school educators at least once every five
4037 years [on a schedule adopted by the agency by rule].
4138 SECTION 2. Section 28.002, Education Code, is amended by
4239 amending Subsection (a) and adding Subsection (a-1) to read as
4340 follows:
4441 (a) Each school district that offers kindergarten through
4542 grade 12 shall offer, as a required curriculum:
4643 (1) a foundation curriculum that includes:
4744 (A) English language arts;
4845 (B) mathematics;
4946 (C) science; and
5047 (D) social studies, consisting of Texas, United
5148 States, and world history, government, economics, with emphasis on
5249 the free enterprise system and its benefits, and geography; and
5350 (2) an enrichment curriculum that includes:
5451 (A) to the extent possible, languages other than
5552 English;
5653 (B) health, with emphasis on:
5754 (i) physical health, including the
5855 importance of proper nutrition and exercise;
5956 (ii) mental health, including instruction
6057 on mental health conditions, substance abuse, skills to manage
6158 emotions, establishing and maintaining positive relationships, and
6259 responsible decision-making; and
6360 (iii) suicide prevention, including
6461 recognizing suicide-related risk factors and warning signs;
6562 (C) physical education;
6663 (D) fine arts;
6764 (E) career and technology education;
6865 (F) technology applications;
6966 (G) religious literature, including the Hebrew
7067 Scriptures (Old Testament) and New Testament, and its impact on
7168 history and literature; and
7269 (H) personal financial literacy.
7370 (a-1) In adopting the essential knowledge and skills for the
7471 health curriculum under Subsection (a)(2)(B), the State Board of
7572 Education shall adopt essential knowledge and skills that address:
7673 (1) the relationship between drug and alcohol use and
7774 suicide;
7875 (2) recognizing signs of suicidal tendencies and other
79- warning signs of suicide; and
80- (3) help-seeking behaviors and available community
76+ warning signs of suicide;
77+ (3) the risk of suicide or violent behavior as a side
78+ effect of psychotropic medication; and
79+ (4) help-seeking behaviors and available community
8180 suicide prevention services.
8281 SECTION 3. Section 28.004, Education Code, is amended by
8382 amending Subsection (c) and adding Subsection (o) to read as
8483 follows:
8584 (c) The local school health advisory council's duties
8685 include recommending:
8786 (1) the number of hours of instruction to be provided
8887 in health education;
8988 (2) policies, procedures, strategies, and curriculum
9089 appropriate for specific grade levels designed to prevent obesity,
9190 cardiovascular disease, Type 2 diabetes, and mental health
9291 concerns, including suicide, through coordination of:
9392 (A) health education;
9493 (B) physical education and physical activity;
9594 (C) nutrition services;
9695 (D) parental involvement;
9796 (E) instruction to prevent the use of
9897 e-cigarettes, as defined by Section 161.081, Health and Safety
9998 Code, and tobacco;
10099 (F) school health services;
101100 (G) counseling and guidance services;
102101 (H) a safe and healthy school environment; and
103102 (I) school employee wellness;
104103 (3) appropriate grade levels and methods of
105104 instruction for human sexuality instruction;
106105 (4) strategies for integrating the curriculum
107106 components specified by Subdivision (2) with the following elements
108107 in a coordinated school health program for the district:
109108 (A) school health services;
110109 (B) counseling and guidance services;
111110 (C) a safe and healthy school environment; and
112111 (D) school employee wellness; and
113112 (5) if feasible, joint use agreements or strategies
114113 for collaboration between the school district and community
115114 organizations or agencies.
116115 (o) The local school health advisory council shall make
117- policy recommendations to the district to increase parental
118- awareness of suicide-related risk factors and warning signs and
119- available community suicide prevention services.

117+ (1) parental awareness of suicide-related risk
118+ factors and warning signs and available community suicide
119+ prevention services; and
120+ (2) school personnel awareness of risks and side
121+ effects associated with psychotropic medications, with particular
122+ attention to suicidal thoughts or actions, agitation, aggression,
123+ hostility, mania, akathisia, and other risks and side effects that
124+ may be associated with violent or self-harming behavior.
120125 SECTION 4. Section 161.325(a-1), Health and Safety Code, as
121126 amended by Chapter 714 (H.B. 4056) and Chapter 522 (S.B. 179), Acts
122127 of the 85th Legislature, Regular Session, 2017, is reenacted and
123128 amended to read as follows:
124129 (a-1) The list must include programs and practices in the
125130 following areas:
126131 (1) early mental health prevention and intervention;
127132 (2) [mental health promotion;
128133 [(3)] substance abuse prevention and intervention;
129134 (3) [(4) substance abuse intervention;
130135 [(5)] suicide prevention, intervention, and
131136 postvention;
132137 (4) [(6)] grief-informed and trauma-informed
133138 practices;
134139 (5) [(7)] building skills related to managing
135140 emotions, establishing and maintaining positive relationships, and
136141 responsible decision-making;
137142 (6) [(8)] positive behavior interventions and
138143 supports and positive youth development; and
139144 (7) [(9)] safe, [and] supportive, and positive school
140145 climate.
141146 SECTION 5. Section 161.325, Health and Safety Code, is
142147 amended by adding Subsection (a-4) and amending Subsections (b) and
143148 (d) to read as follows:
144149 (a-4) In this section, "postvention" includes activities
145150 that promote healing necessary to reduce the risk of suicide by a
146151 person affected by the suicide of another.
147152 (b) The suicide prevention programs on the list must include
148153 components that provide for training counselors, teachers, nurses,
149154 administrators, and other staff, as well as law enforcement
150155 officers and social workers who regularly interact with students,
151156 to:
152157 (1) recognize students at risk of committing suicide,
153158 including students who are or may be the victims of or who engage in
154159 bullying;
155160 (2) recognize students displaying early warning signs
156161 and a possible need for early mental health or substance abuse
157162 intervention, which warning signs may include declining academic
158163 performance, depression, anxiety, isolation, unexplained changes
159164 in sleep or eating habits, and destructive behavior toward self and
160165 others; [and]
161166 (3) intervene effectively with students described by
162167 Subdivision (1) or (2) by providing notice and referral to a parent
163168 or guardian so appropriate action, such as seeking mental health or
164169 substance abuse services, may be taken by a parent or guardian; and
165170 (4) assist students in returning to school following
166171 treatment of a mental health concern or suicide attempt.
167172 (d) A school district shall [may] develop practices and
168173 procedures concerning each area listed in Subsection (a-1),
169174 including mental health promotion and intervention, substance
170175 abuse prevention and intervention, and suicide prevention, that:
171176 (1) include a procedure for providing notice of a
172177 recommendation for early mental health or substance abuse
173178 intervention regarding a student to a parent or guardian of the
174179 student within a reasonable amount of time after the identification
175180 of early warning signs as described by Subsection (b)(2);
176181 (2) include a procedure for providing notice of a
177182 student identified as at risk of committing suicide to a parent or
178183 guardian of the student within a reasonable amount of time after the
179184 identification of early warning signs as described by Subsection
180185 (b)(2);
181186 (3) establish that the district may develop a
182187 reporting mechanism and may designate at least one person to act as
183188 a liaison officer in the district for the purposes of identifying
184189 students in need of early mental health or substance abuse
185190 intervention or suicide prevention; [and]
186191 (4) set out available counseling alternatives for a
187192 parent or guardian to consider when their child is identified as
188193 possibly being in need of early mental health or substance abuse
189194 intervention or suicide prevention; and
190195 (5) include procedures:
191196 (A) to support the return of a student to school
192197 following hospitalization or residential treatment for a mental
193198 health condition or substance abuse; and
194199 (B) for suicide prevention, intervention, and
195200 postvention.
196201 SECTION 6. This Act takes effect September 1, 2019.
