411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to the location of the Alamo Cenotaph.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Subchapter K, Chapter 2166, Government Code, is
916 amended by adding Section 2166.5012 to read as follows:
1017 Sec. 2166.5012. ALAMO CENOTAPH. (a) In this section,
1118 "Alamo Cenotaph" means the memorial to the Alamo defenders located
1219 in the Alamo complex.
1320 (b) Notwithstanding Subchapter I, Chapter 31, Natural
1421 Resources Code, or any other law, the City of San Antonio, or any
1522 other entity, may not move the Alamo Cenotaph from the location
1623 where the cenotaph was first placed following its completion
1724 unless:
1825 (1) the move is approved in a public hearing by at
1926 least two of the following:
2027 (A) the commissioner of the General Land Office;
2128 (B) one member of the Texas Historical Commission
2229 who is designated by the commission to represent the commission;
2330 and
2431 (C) one officer of the Daughters of the Republic
2532 of Texas who is designated by the organization's officers to
2633 represent the organization; and
2734 (2) the cenotaph is moved:
2835 (A) temporarily for repairs; or
2936 (B) permanently to a location within the Alamo
3037 Plaza.
3138 SECTION 2. This Act takes effect September 1, 2019.
