| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Subchapter K, Chapter 2166, Government Code, is |
|---|
| 9 | 16 | | amended by adding Section 2166.5012 to read as follows: |
|---|
| 10 | 17 | | Sec. 2166.5012. ALAMO CENOTAPH. (a) In this section, |
|---|
| 11 | 18 | | "Alamo Cenotaph" means the memorial to the Alamo defenders located |
|---|
| 12 | 19 | | in the Alamo complex. |
|---|
| 13 | 20 | | (b) Notwithstanding Subchapter I, Chapter 31, Natural |
|---|
| 14 | 21 | | Resources Code, or any other law, the City of San Antonio, or any |
|---|
| 15 | 22 | | other entity, may not move the Alamo Cenotaph from the location |
|---|
| 16 | 23 | | where the cenotaph was first placed following its completion |
|---|
| 17 | 24 | | unless: |
|---|
| 18 | 25 | | (1) the move is approved in a public hearing by at |
|---|
| 19 | 26 | | least two of the following: |
|---|
| 20 | 27 | | (A) the commissioner of the General Land Office; |
|---|
| 21 | 28 | | (B) one member of the Texas Historical Commission |
|---|
| 22 | 29 | | who is designated by the commission to represent the commission; |
|---|
| 23 | 30 | | and |
|---|
| 24 | 31 | | (C) one officer of the Daughters of the Republic |
|---|
| 25 | 32 | | of Texas who is designated by the organization's officers to |
|---|
| 26 | 33 | | represent the organization; and |
|---|
| 27 | 34 | | (2) the cenotaph is moved: |
|---|
| 28 | 35 | | (A) temporarily for repairs; or |
|---|
| 29 | 36 | | (B) permanently to a location within the Alamo |
|---|
| 30 | 37 | | Plaza. |
|---|
| 31 | 38 | | SECTION 2. This Act takes effect September 1, 2019. |
