55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the services provided by assisted living facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 247.002(1), Health and Safety Code, is
1010 amended to read as follows:
1111 (1) "Assisted living facility" means an establishment
1212 that:
1313 (A) furnishes, in one or more facilities, food
1414 and shelter to four or more persons who are unrelated to the
1515 proprietor of the establishment;
1616 (B) provides:
1717 (i) personal care services; or
1818 (ii) administration of medication by a
1919 person licensed or otherwise authorized in this state to administer
2020 the medication;
2121 (C) may provide assistance with or supervision of
2222 the administration of medication; [and]
2323 (D) may provide skilled nursing services for the
2424 following limited purposes:
2525 (i) coordination of resident care with
2626 outside home and community support services agencies and other
2727 health care professionals;
2828 (ii) provision or delegation of personal
2929 care services and medication administration as described by this
3030 subdivision;
3131 (iii) assessment of residents to determine
3232 the care required; and
3333 (iv) for periods of time as established by
3434 department rule, delivery of temporary skilled nursing treatment
3535 for a minor illness, injury, or emergency; and
3636 (E) may provide health maintenance activities as
3737 defined by rule by the Texas Board of Nursing.
3838 SECTION 2. Section 247.025, Health and Safety Code, is
3939 amended to read as follows:
4040 Sec. 247.025. ADOPTION OF RULES. (a) The executive
4141 commissioner shall adopt rules necessary to implement this chapter,
4242 including requirements for the issuance, renewal, denial,
4343 suspension, and revocation of a license to operate an assisted
4444 living facility.
4545 (b) The executive commissioner shall adopt rules
4646 distinguishing and providing guidelines on the scope of services
4747 that an assisted living facility may provide under this chapter.
4848 SECTION 3. As soon as practicable after the effective date
4949 of this Act:
5050 (1) the Texas Board of Nursing shall adopt the rules
5151 necessary to implement Section 247.002(1), Health and Safety Code,
5252 as amended by this Act; and
5353 (2) the executive commissioner of the Health and Human
5454 Services Commission shall adopt the rules required by Section
5555 247.025, Health and Safety Code, as amended by this Act.
5656 SECTION 4. This Act takes effect September 1, 2019.
