85 AN ACT
9- relating to accountability intervention provisions applicable to
10- school district campuses, including the creation of accelerated
11- campus excellence turnaround plans and the conditions under which a
12- closed campus may be repurposed to serve students at that campus
13- location.

149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. Section 39A.105, Education Code, is amended to
1611 read as follows:
1712 Sec. 39A.105. CONTENTS OF CAMPUS TURNAROUND PLAN. (a) A
1813 campus turnaround plan must include:
1914 (1) details on the method for restructuring,
2015 reforming, or reconstituting the campus;
2116 (2) a detailed description of the academic programs to
2217 be offered at the campus, including:
2318 (A) instructional methods;
2419 (B) length of school day and school year;
2520 (C) academic credit and promotion criteria; and
2621 (D) programs to serve special student
2722 populations;
2823 (3) if a district charter is to be granted for the
2924 campus under Section 12.0522:
3025 (A) the term of the charter; and
3126 (B) information on the implementation of the
3227 charter;
3328 (4) written comments from:
3429 (A) the campus-level committee established under
3530 Section 11.251, if applicable;
3631 (B) parents; and
3732 (C) teachers at the campus; and
3833 (5) a detailed description of the budget, staffing,
3934 and financial resources required to implement the plan, including
4035 any supplemental resources to be provided by the school district or
4136 other identified sources.
4237 (b) A campus may submit an accelerated campus excellence
4338 turnaround plan as provided by this subsection. The plan must
4439 provide:
4540 (1) the assignment of a principal to the campus who has
4641 demonstrated a history of improvement in student academic growth at
4742 campuses in which the principal has previously worked;
4843 (2) that the principal has final authority over
4944 personnel decisions at the campus;
5045 (3) that at least 80 percent of the classroom teachers
5146 assigned to the campus be teachers who performed in the top quartile
5247 of teachers in the district that employed the teacher during the
5348 previous school year, with performance determined by:
5449 (A) for a teacher who taught in the district
5550 during the previous school year:
5651 (i) the teacher's impact on student growth;
5752 and
5853 (ii) an evaluation of the teacher based on
5954 classroom observation; and
6055 (B) for a teacher who did not teach in the
6156 district during the previous school year, data and other evidence
6257 indicating that if the teacher had taught in the district during the
6358 previous school year, the teacher would have performed in the top
6459 quartile of teachers in the district;
6560 (4) a detailed description of the employment and
6661 compensation structures for the principal and classroom teachers,
6762 which must include:
6863 (A) significant incentives for a high-performing
6964 principal or teacher to remain at the campus; and
7065 (B) a three-year commitment by the district to
7166 continue incentives for the principal and teachers;
7267 (5) policies and procedures for the implementation of
7368 best practices at the campus, including:
7469 (A) data-driven instructional practices;
7570 (B) a system of observation of and feedback for
7671 classroom teachers;
7772 (C) positive student culture on the campus;
7873 (D) family and community engagement, including
7974 partnerships with parent and community groups;
8075 (E) extended learning opportunities for
8176 students, which may include service or workforce learning
8277 opportunities; and
8378 (F) providing student services before or after
8479 the instructional day that improve student performance, which may
8580 include tutoring, extracurricular activities, counseling services,
8681 and offering breakfast, lunch, and dinner to all students at the
8782 campus; and
8883 (6) assistance by a third-party provider that is
8984 approved by the commissioner in the development and implementation
9085 of the district's plan.
9186 (c) The commissioner may provide guidance to districts as
9287 necessary to implement an accelerated campus excellence turnaround
9388 plan under Subsection (b).
9489 SECTION 2. Section 39A.107, Education Code, is amended by
9590 adding Subsection (a-3) to read as follows:
9691 (a-3) Notwithstanding Subsection (a), the commissioner
9792 shall approve a campus turnaround plan that the commissioner
9893 determines meets the requirements for an accelerated campus
9994 excellence turnaround plan under Section 39A.105(b).
100- SECTION 3. Section 39A.113, Education Code, is amended by
101- amending Subsections (a) and (b) and adding Subsection (a-1) to
102- read as follows:
103- (a) If the commissioner orders the closure of a campus under
104- this subchapter, that campus may be repurposed to serve students at
105- that campus location only if the commissioner:
106- (1) finds that the repurposed campus [:
107- [(A)] offers a distinctly different academic
108- program[;] and:
109- (A) [(B)] serves a majority of grade levels not
110- served at the original campus; or [and]
111- (B) is operated under a contract, approved by the
112- school district board of trustees, with a nonprofit organization
113- exempt from federal taxation under Section 501(c)(3), Internal
114- Revenue Code of 1986, that:
115- (i) has a governing board that is
116- independent of the district;
117- (ii) has a successful history of operating
118- school district campuses or open-enrollment charter schools:
119- (a) that cumulatively serve 10,000 or
120- more students; and
121- (b) a majority of which have been
122- assigned an overall performance rating of B or higher under Section
123- 39.054 for the preceding school year; and
124- (iii) has been assigned an overall
125- performance rating of B or higher under Section 39.054 for the
126- preceding school year; and
127- (2) approves a new campus identification number for
128- the repurposed campus.
129- (a-1) A contract described by Subsection (a)(1)(B) must
130- provide that a student residing in the attendance zone of the campus
131- immediately before the campus was repurposed shall be admitted for
132- enrollment at the repurposed campus.
133- (b) The majority of students assigned to a campus that has
134- been closed and repurposed under Subsection (a)(1)(A) may not have
135- attended that campus in the previous school year.
136- SECTION 4. Subchapter C, Chapter 39A, Education Code, is

13897 Sec. 39A.116. COMMISSIONER AUTHORITY. A decision by the
13998 commissioner under this subchapter is final and may not be

141- SECTION 5. (a) The commissioner of education shall select

149108 selected by the commissioner under this section for purposes of
150109 developing and implementing the accelerated campus excellence
151110 turnaround plan.
152111 (b) Except as provided by Subsection (a) of this section,
153- Sections 39A.105 and 39A.107, Education Code, as amended by this
154- Act, and Section 39A.116, Education Code, as added by this Act,
155- apply beginning with the 2020-2021 school year.
156- SECTION 6. The commissioner of education may adopt rules
