6	6	AN ACT
7	7	relating to the composition of the port commission of the Port of
8	8	Corpus Christi Authority of Nueces County, Texas.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1A, Chapter 397, Acts of the 68th
11	11	Legislature, Regular Session, 1983, as added by Chapter 498, Acts
12	12	of the 81st Legislature, Regular Session, 2009, is amended to read
13	13	as follows:
14	14	Sec. 1A. COMPOSITION OF PORT COMMISSION. The port
15	15	commission is composed of nine port commissioners [seven members].
16	16	SECTION 2. Section 2(a), Chapter 397, Acts of the 68th
17	17	Legislature, Regular Session, 1983, is amended to read as follows:
18	18	(a) Port commissioners are appointed as follows:
19	19	(1) the commissioners court [The Commissioners Court]
20	20	of Nueces County shall appoint three port commissioners;
21	21	(2) the city council of the City of Corpus Christi
22	22	shall appoint three port commissioners; and
23	23	(3) the commissioners court of San Patricio County
24	24	shall appoint three port commissioners [four members to the port
25	25	commission, and the City Council of Corpus Christi shall appoint
26	26	three members to the port commission].
27	27	SECTION 3. Sections 1, 2, 3, and 4, Chapter 1334, Acts of
28	28	the 78th Legislature, Regular Session, 2003, are repealed.
29	29	SECTION 4. Not later than one year after the effective date
30	30	of this Act, the commissioners court of San Patricio County shall
31	31	appoint two port commissioners to the port commission of the Port of
32	32	Corpus Christi Authority of Nueces County, Texas, as provided by
33	33	Section 2(a), Chapter 397, Acts of the 68th Legislature, Regular
34	34	Session, 1983, as amended by this Act, to serve terms that expire on
35	35	dates that preserve the required staggering of terms.
36	36	SECTION 5. To the extent of any conflict, this Act prevails
37	37	over another Act of the 86th Legislature, Regular Session, 2019,
38	38	relating to nonsubstantive additions to and corrections in enacted
39	39	codes.
40	40	SECTION 6. (a) The legal notice of the intention to
41	41	introduce this Act, setting forth the general substance of this
42	42	Act, has been published as provided by law, and the notice and a
43	43	copy of this Act have been furnished to all persons, agencies,
44	44	officials, or entities to which they are required to be furnished
45	45	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
46	46	Government Code.
47	47	(b) The governor, one of the required recipients, has
48	48	submitted the notice and Act to the Texas Commission on
49	49	Environmental Quality.
50	50	(c) The Texas Commission on Environmental Quality has filed
51	51	its recommendations relating to this Act with the governor, the
52	52	lieutenant governor, and the speaker of the house of
53	53	representatives within the required time.
54	54	(d) All requirements of the constitution and laws of this
55	55	state and the rules and procedures of the legislature with respect
56	56	to the notice, introduction, and passage of this Act are fulfilled
57	57	and accomplished.
58	58	SECTION 7. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2019.
