7 | 7 | | relating to the deadline for filing a request for binding |
---|
8 | 8 | | arbitration of certain appraisal review board orders. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 41A.03(a), Tax Code, is amended to read |
---|
11 | 11 | | as follows: |
---|
12 | 12 | | (a) To appeal an appraisal review board order under this |
---|
13 | 13 | | chapter, a property owner must file with the appraisal district not |
---|
14 | 14 | | later than the 60th [45th] day after the date the property owner |
---|
15 | 15 | | receives notice of the order: |
---|
16 | 16 | | (1) a completed request for binding arbitration under |
---|
17 | 17 | | this chapter in the form prescribed by Section 41A.04; and |
---|
18 | 18 | | (2) an arbitration deposit made payable to the |
---|
19 | 19 | | comptroller in the amount of: |
---|
20 | 20 | | (A) $450, if the property qualifies as the |
---|
21 | 21 | | owner's residence homestead under Section 11.13 and the appraised |
---|
22 | 22 | | or market value, as applicable, of the property is $500,000 or less, |
---|
23 | 23 | | as determined by the order; |
---|
24 | 24 | | (B) $500, if the property qualifies as the |
---|
25 | 25 | | owner's residence homestead under Section 11.13 and the appraised |
---|
26 | 26 | | or market value, as applicable, of the property is more than |
---|
27 | 27 | | $500,000, as determined by the order; |
---|
28 | 28 | | (C) $500, if the property does not qualify as the |
---|
29 | 29 | | owner's residence homestead under Section 11.13 and the appraised |
---|
30 | 30 | | or market value, as applicable, of the property is $1 million or |
---|
31 | 31 | | less, as determined by the order; |
---|
32 | 32 | | (D) $800, if the property does not qualify as the |
---|
33 | 33 | | owner's residence homestead under Section 11.13 and the appraised |
---|
34 | 34 | | or market value, as applicable, of the property is more than $1 |
---|
35 | 35 | | million but not more than $2 million, as determined by the order; |
---|
36 | 36 | | (E) $1,050, if the property does not qualify as |
---|
37 | 37 | | the owner's residence homestead under Section 11.13 and the |
---|
38 | 38 | | appraised or market value, as applicable, of the property is more |
---|
39 | 39 | | than $2 million but not more than $3 million, as determined by the |
---|
40 | 40 | | order; or |
---|
41 | 41 | | (F) $1,550, if the property does not qualify as |
---|
42 | 42 | | the owner's residence homestead under Section 11.13 and the |
---|
43 | 43 | | appraised or market value, as applicable, of the property is more |
---|
44 | 44 | | than $3 million but not more than $5 million, as determined by the |
---|
45 | 45 | | order. |
---|
46 | 46 | | SECTION 2. This Act applies only to an appeal of an |
---|
47 | 47 | | appraisal review board order that a property owner receives notice |
---|
48 | 48 | | of on or after the effective date of this Act. An appeal of an |
---|
49 | 49 | | appraisal review board order that a property owner receives notice |
---|
50 | 50 | | of before the effective date of this Act is governed by the law in |
---|
51 | 51 | | effect immediately before the effective date of this Act, and that |
---|
52 | 52 | | law is continued in effect for that purpose. |
---|
53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2019. |
