55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement for and the contents of a declarations
88 page required for certain standard insurance policy forms for
99 personal automobile insurance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2301.056, Insurance Code, is amended by
1212 amending Subsection (a) and adding Subsection (b-1) to read as
1313 follows:
1414 (a) A personal automobile or residential property insurance
1515 policy form must include a declarations page that:
1616 (1) lists and identifies each type of deductible under
1717 the [residential property insurance] policy; and
1818 (2) states the exact dollar amount of each deductible
1919 under the [residential property insurance] policy.
2020 (b-1) If a personal automobile insurance policy or an
2121 endorsement attached to the policy contains a provision that may
2222 cause the exact dollar amount of a deductible under the policy to
2323 increase from the initial amount selected by the policyholder, the
2424 declarations page must identify or include a written disclosure
2525 that clearly identifies the applicable policy provision or
2626 endorsement. The policy provision or endorsement must explain how
2727 any increase in the applicable deductible amount is determined.
2828 SECTION 2. The change in law made by this Act applies only
2929 to a personal automobile insurance policy delivered, issued for
3030 delivery, or renewed on or after January 1, 2020. A personal
3131 automobile insurance policy delivered, issued for delivery, or
3232 renewed before January 1, 2020, is governed by the law as it existed
3333 immediately before the effective date of this Act, and that law is
3434 continued in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2019.
