| 8 | 8 | | page required for certain standard insurance policy forms for |
|---|
| 9 | 9 | | personal automobile insurance. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2301.056, Insurance Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (a) and adding Subsection (b-1) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) A personal automobile or residential property insurance |
|---|
| 15 | 15 | | policy form must include a declarations page that: |
|---|
| 16 | 16 | | (1) lists and identifies each type of deductible under |
|---|
| 17 | 17 | | the [residential property insurance] policy; and |
|---|
| 18 | 18 | | (2) states the exact dollar amount of each deductible |
|---|
| 19 | 19 | | under the [residential property insurance] policy. |
|---|
| 20 | 20 | | (b-1) If a personal automobile insurance policy or an |
|---|
| 21 | 21 | | endorsement attached to the policy contains a provision that may |
|---|
| 22 | 22 | | cause the exact dollar amount of a deductible under the policy to |
|---|
| 23 | 23 | | increase from the initial amount selected by the policyholder, the |
|---|
| 24 | 24 | | declarations page must identify or include a written disclosure |
|---|
| 25 | 25 | | that clearly identifies the applicable policy provision or |
|---|
| 26 | 26 | | endorsement. The policy provision or endorsement must explain how |
|---|
| 27 | 27 | | any increase in the applicable deductible amount is determined. |
|---|
| 28 | 28 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 29 | 29 | | to a personal automobile insurance policy delivered, issued for |
|---|
| 30 | 30 | | delivery, or renewed on or after January 1, 2020. A personal |
|---|
| 31 | 31 | | automobile insurance policy delivered, issued for delivery, or |
|---|
| 32 | 32 | | renewed before January 1, 2020, is governed by the law as it existed |
|---|
| 33 | 33 | | immediately before the effective date of this Act, and that law is |
|---|
| 34 | 34 | | continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2019. |
