55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of rural hospitals to establish a health
88 care collaborative.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 848.001, Insurance Code, is amended by
1111 amending Subdivision (2) and adding Subdivision (10) to read as
1212 follows:
1313 (2) "Health care collaborative" means an entity:
1414 (A) that undertakes to arrange for medical and
1515 health care services for insurers, health maintenance
1616 organizations, and other payors in exchange for payments in cash or
1717 in kind;
1818 (B) that accepts and distributes payments for
1919 medical and health care services;
2020 (C) that consists of:
2121 (i) physicians;
2222 (ii) rural hospitals;
2323 (iii) physicians and other health care
2424 providers;
2525 (iv) [(iii)] physicians and insurers or
2626 health maintenance organizations; or
2727 (v) [(iv)] physicians, other health care
2828 providers, and insurers or health maintenance organizations; and
2929 (D) that is certified by the commissioner under
3030 this chapter to lawfully accept and distribute payments to
3131 physicians and other health care providers using the reimbursement
3232 methodologies authorized by this chapter.
3333 (10) "Rural hospital" means a licensed hospital with
3434 75 beds or fewer that:
3535 (A) is located in a county with a population of
3636 50,000 or less; or
3737 (B) has been designated by the Centers for
3838 Medicare and Medicaid Services as a critical access hospital, rural
3939 referral center, or sole community hospital.
4040 SECTION 2. Section 848.052, Insurance Code, is amended by
4141 adding Subsection (c-1) to read as follows:
4242 (c-1) If the participants in a health care collaborative are
4343 all rural hospitals, each member of the board of directors must be a
4444 representative of a participant.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2019.
