| 7 | 7 | | relating to the authority of rural hospitals to establish a health |
|---|
| 8 | 8 | | care collaborative. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 848.001, Insurance Code, is amended by |
|---|
| 11 | 11 | | amending Subdivision (2) and adding Subdivision (10) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (2) "Health care collaborative" means an entity: |
|---|
| 14 | 14 | | (A) that undertakes to arrange for medical and |
|---|
| 15 | 15 | | health care services for insurers, health maintenance |
|---|
| 16 | 16 | | organizations, and other payors in exchange for payments in cash or |
|---|
| 17 | 17 | | in kind; |
|---|
| 18 | 18 | | (B) that accepts and distributes payments for |
|---|
| 19 | 19 | | medical and health care services; |
|---|
| 20 | 20 | | (C) that consists of: |
|---|
| 21 | 21 | | (i) physicians; |
|---|
| 22 | 22 | | (ii) rural hospitals; |
|---|
| 23 | 23 | | (iii) physicians and other health care |
|---|
| 24 | 24 | | providers; |
|---|
| 25 | 25 | | (iv) [(iii)] physicians and insurers or |
|---|
| 26 | 26 | | health maintenance organizations; or |
|---|
| 27 | 27 | | (v) [(iv)] physicians, other health care |
|---|
| 28 | 28 | | providers, and insurers or health maintenance organizations; and |
|---|
| 29 | 29 | | (D) that is certified by the commissioner under |
|---|
| 30 | 30 | | this chapter to lawfully accept and distribute payments to |
|---|
| 31 | 31 | | physicians and other health care providers using the reimbursement |
|---|
| 32 | 32 | | methodologies authorized by this chapter. |
|---|
| 33 | 33 | | (10) "Rural hospital" means a licensed hospital with |
|---|
| 34 | 34 | | 75 beds or fewer that: |
|---|
| 35 | 35 | | (A) is located in a county with a population of |
|---|
| 36 | 36 | | 50,000 or less; or |
|---|
| 37 | 37 | | (B) has been designated by the Centers for |
|---|
| 38 | 38 | | Medicare and Medicaid Services as a critical access hospital, rural |
|---|
| 39 | 39 | | referral center, or sole community hospital. |
|---|
| 40 | 40 | | SECTION 2. Section 848.052, Insurance Code, is amended by |
|---|
| 41 | 41 | | adding Subsection (c-1) to read as follows: |
|---|
| 42 | 42 | | (c-1) If the participants in a health care collaborative are |
|---|
| 43 | 43 | | all rural hospitals, each member of the board of directors must be a |
|---|
| 44 | 44 | | representative of a participant. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2019. |
