77 relating to retaliation for municipal annexation disapproval.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 43.0688, Local Government Code, is
1010 amended by amending Subsection (a) and adding Subsection (c) to
1111 read as follows:
1212 (a) The disapproval of the proposed annexation of an area
1313 under this subchapter does not affect any existing legal obligation
1414 of the municipality proposing the annexation to continue to provide
1515 governmental services in the area, including water or wastewater
1616 services, regardless of whether the municipality holds a
1717 certificate of convenience and necessity to serve the area.
1818 (c) A municipality that makes a wholesale sale of water to a
1919 special district operating under Chapter 36 or Title 4, Water Code,
2020 may not charge rates for the water that are higher than rates
2121 charged in other similarly situated areas solely because the
2222 district is wholly or partly located in an area that disapproved of
2323 a proposed annexation under this subchapter.
2424 SECTION 2. Section 43.0699, Local Government Code, is
2525 amended by amending Subsection (a) and adding Subsection (c) to
2626 read as follows:
2727 (a) The disapproval of the proposed annexation of an area
2828 under this subchapter does not affect any existing legal obligation
2929 of the municipality proposing the annexation to continue to provide
3030 governmental services in the area, including water or wastewater
3131 services, regardless of whether the municipality holds a
3232 certificate of convenience and necessity to serve the area.
3333 (c) A municipality that makes a wholesale sale of water to a
3434 special district operating under Chapter 36 or Title 4, Water Code,
3535 may not charge rates for the water that are higher than rates
3636 charged in other similarly situated areas solely because the
3737 district is wholly or partly located in an area that disapproved of
3838 a proposed annexation under this subchapter.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2019.
