8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 21.351, Education Code, is amended by |
---|
10 | 12 | | adding Subsection (a-1) to read as follows: |
---|
11 | 13 | | (a-1) In adopting criteria described by Subsection (a)(1), |
---|
12 | 14 | | the commissioner shall ensure that a teacher may not be assigned an |
---|
13 | 15 | | area of deficiency in an appraisal solely on the basis of |
---|
14 | 16 | | disciplinary referrals made by the teacher or documentation |
---|
15 | 17 | | regarding student conduct submitted by the teacher under Section |
---|
16 | 18 | | 37.002. This subsection does not prohibit a teacher from being |
---|
17 | 19 | | assigned an area of deficiency based on documented evidence of a |
---|
18 | 20 | | deficiency in classroom management obtained through observation or |
---|
19 | 21 | | a substantiated report. |
---|
20 | 22 | | SECTION 2. Section 21.352, Education Code, is amended by |
---|
21 | 23 | | adding Subsection (a-1) to read as follows: |
---|
22 | 24 | | (a-1) A school district may not assign an area of deficiency |
---|
23 | 25 | | to a teacher solely on the basis of disciplinary referrals made by |
---|
24 | 26 | | the teacher or documentation regarding student conduct submitted by |
---|
25 | 27 | | the teacher under Section 37.002. This subsection does not |
---|
26 | 28 | | prohibit a teacher from being assigned an area of deficiency based |
---|
27 | 29 | | on documented evidence of a deficiency in classroom management |
---|
28 | 30 | | obtained through observation or a substantiated report. |
---|
29 | 31 | | SECTION 3. Section 37.002, Education Code, is amended by |
---|
42 | 38 | | SECTION 4. This Act applies beginning with the 2019-2020 |
---|
43 | 39 | | school year. |
---|
44 | 40 | | SECTION 5. This Act takes effect immediately if it receives |
---|
45 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 44 | | Act takes effect September 1, 2019. |
