9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 211, Local Government | |
11 | 11 | Code, is amended by adding Section 211.0165 to read as follows: | |
12 | 12 | Sec. 211.0165. OWNER CONSENT REQUIRED TO DESIGNATE HISTORIC | |
13 | 13 | LANDMARK. A municipality that has established a process for | |
14 | 14 | designating places or areas of historical, cultural, or | |
15 | 15 | architectural importance and significance through the adoption of | |
16 | 16 | zoning regulations or zoning district boundaries may not designate | |
17 | 17 | a property as a local historic landmark unless the owner of the | |
18 | 18 | property consents to the designation. The municipality must allow | |
19 | 19 | an owner to withdraw consent at any time during the designation | |
20 | 20 | process. | |
21 | 21 | SECTION 2. Section 211.0165, Local Government Code, as | |
22 | 22 | added by this Act, applies only to a designation of a property as a | |
23 | 23 | historic landmark made on or after the effective date of this Act. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2019. |
