55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to designating the Texas Division of Emergency Management
88 as the state liaison to the United States Army Corps of Engineers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1111 amended by adding Section 418.054 to read as follows:
1212 Sec. 418.054. LIAISON TO UNITED STATES ARMY CORPS OF
1313 ENGINEERS. (a) In this section, "corps of engineers" means the
1414 United States Army Corps of Engineers.
1515 (b) The division is the state liaison to the corps of
1616 engineers except as provided by Section 16.091, Water Code.
1717 (c) The division shall:
1818 (1) serve as a clearinghouse for monitoring:
1919 (A) federal appropriations for projects of the
2020 corps of engineers in this state; and
2121 (B) projects of the corps of engineers that are
2222 under construction in this state, including:
2323 (i) progress on the project and expected
2424 completion date; and
2525 (ii) the total cost of the project, the
2626 amount and due date of any local matching funds requirement, any
2727 interest being incurred on the local matching funds, and how the
2828 local sponsor of the project plans to pay the local matching funds
2929 requirement;
3030 (2) monitor studies being conducted in this state for
3131 potential corps of engineers projects and how much the total cost
3232 and local matching funds requirement would be for the project;
3333 (3) develop statewide standards and guidelines for
3434 complying with federal regulations and requirements for corps of
3535 engineers project procurement; and
3636 (4) act as a liaison between the corps of engineers,
3737 relevant state agencies, and local sponsors of projects to ensure
3838 efficient communication and consolidation of information relating
3939 to existing and potential projects.
4040 (d) This section may not be construed as making the division
4141 or this state responsible for any local matching funds requirement
4242 for a corps of engineers project.
4343 (e) The division may delegate any of its responsibilities
4444 and duties under this section to the Emergency Management Council,
4545 if appropriate.
4646 SECTION 2. This Act takes effect September 1, 2019.
