7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 1603.102, Occupations Code, is amended |
---|
9 | 9 | | to read as follows: |
---|
10 | 10 | | Sec. 1603.102. SANITATION RULES. (a) The commission shall |
---|
11 | 11 | | establish sanitation rules to prevent the spread of an infectious |
---|
12 | 12 | | or contagious disease. |
---|
13 | 13 | | (b) Rules adopted under this section applicable to an |
---|
14 | 14 | | individual or facility regulated under Chapter 1602 shall be |
---|
15 | 15 | | consistent with the standards and terminology related to safety and |
---|
16 | 16 | | sanitation that are commonly used in the cosmetology industry. |
---|
17 | 17 | | SECTION 2. Section 1603.256(c), Occupations Code, is |
---|
18 | 18 | | amended to read as follows: |
---|
19 | 19 | | (c) The following persons may administer a practical |
---|
20 | 20 | | examination required under this subchapter: |
---|
21 | 21 | | (1) the department; [or] |
---|
22 | 22 | | (2) a person with whom the department contracts under |
---|
23 | 23 | | Section 1603.252; or |
---|
24 | 24 | | (3) a private beauty culture school or a vocational |
---|
25 | 25 | | cosmetology program in a public school licensed under this chapter |
---|
26 | 26 | | or Chapter 1602. |
---|
27 | 27 | | SECTION 3. The change in law made by this Act to Section |
---|
28 | 28 | | 1603.256(c), Occupations Code, applies to an examination |
---|
29 | 29 | | administered on or after the effective date of this Act. An |
---|
30 | 30 | | examination administered before the effective date of this Act is |
---|
31 | 31 | | governed by the law in effect on the date the examination was |
---|
32 | 32 | | administered, and that law is continued in effect for that purpose. |
---|
33 | 33 | | SECTION 4. This Act takes effect September 1, 2019. |
