55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reimbursement of providers for the provision of
88 certain home telemonitoring services under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 531.02164, Government Code, is amended
1111 by adding Subsection (c-1) to read as follows:
1212 (c-1) Notwithstanding Subsection (c)(1), the program
1313 required under this section must also provide that home
1414 telemonitoring services are available to pediatric persons who:
1515 (1) are being concurrently treated by at least three
1616 medical specialists;
1717 (2) are diagnosed with end-stage solid organ disease;
1818 (3) have received an organ transplant; or
1919 (4) require mechanical ventilation.
2020 SECTION 2. Section 531.02176, Government Code, is repealed.
2121 SECTION 3. The executive commissioner of the Health and
2222 Human Services Commission shall adopt the rules necessary to
2323 implement Section 531.02164(c-1), Government Code, as added by this
2424 Act, not later than December 1, 2019.
2525 SECTION 4. If before implementing any provision of this Act
2626 a state agency determines that a waiver or authorization from a
2727 federal agency is necessary for implementation of that provision,
2828 the agency affected by the provision shall request the waiver or
2929 authorization and may delay implementing that provision until the
3030 waiver or authorization is granted.
3131 SECTION 5. This Act takes effect September 1, 2019.
