8 | 8 | | renewal and eligibility recertification for certain children in the |

9 | 9 | | Medicaid and child health plan programs. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 62, Health and Safety |
---|
12 | 12 | | Code, is amended by adding Section 62.1025 to read as follows: |
---|
13 | 13 | | Sec. 62.1025. ELIGIBILITY RENEWAL DEMONSTRATION PROJECT. |
---|
14 | 14 | | (a) The commission shall establish a demonstration project in one |
---|
15 | 15 | | or more geographic areas of this state through the child health plan |
---|
16 | 16 | | program to allow the commission to simultaneously renew the |
---|
17 | 17 | | eligibility and review the household income of each child residing |
---|
18 | 18 | | in the same household who is eligible for enrollment in the program. |
---|
19 | 19 | | (b) The executive commissioner shall adopt rules to |
---|
20 | 20 | | determine the scope of, and eligibility for participation in, the |
---|
21 | 21 | | demonstration project. The rules adopted by the executive |
---|
22 | 22 | | commissioner under this subsection shall ensure that the household |
---|
23 | 23 | | income of each child participating in the demonstration project is |
---|
24 | 24 | | reviewed: |
---|
25 | 25 | | (1) not more than twice during the 12-month period |
---|
26 | 26 | | during which a child remains eligible to receive child health plan |
---|
27 | 27 | | program benefits, including at the time eligibility under the |
---|
28 | 28 | | program is renewed; and |
---|
29 | 29 | | (2) at the same time as each other child residing in |
---|
30 | 30 | | the same household who is eligible for enrollment in the program. |
---|
31 | 31 | | (c) If feasible, the commission shall operate the |
---|
32 | 32 | | demonstration project established under this section in |
---|
33 | 33 | | conjunction with the demonstration project established under |
---|
34 | 34 | | Section 32.02614, Human Resources Code. |
---|
35 | 35 | | (d) Not later than December 1, 2022, the commission shall |
---|
36 | 36 | | submit a report to the legislature regarding the commission's |
---|
37 | 37 | | progress in establishing and operating the demonstration project |
---|
38 | 38 | | and recommendations on continuing or expanding the demonstration |
---|
39 | 39 | | project. |
---|
40 | 40 | | (e) This section expires September 1, 2023. |
---|
41 | 41 | | SECTION 2. Subchapter B, Chapter 32, Human Resources Code, |
---|
42 | 42 | | is amended by adding Section 32.02614 to read as follows: |
---|
43 | 43 | | Sec. 32.02614. ELIGIBILITY RECERTIFICATION DEMONSTRATION |
---|
44 | 44 | | PROJECT. (a) The commission shall establish a demonstration |
---|
45 | 45 | | project in one or more geographic areas of this state through the |
---|
46 | 46 | | medical assistance program to allow the commission to |
---|
47 | 47 | | simultaneously recertify the eligibility and verify the household |
---|
48 | 48 | | income of each child residing in the same household who is eligible |
---|
49 | 49 | | for medical assistance under this chapter. |
---|
50 | 50 | | (b) The executive commissioner shall adopt rules to |
---|
51 | 51 | | determine the scope of, and eligibility for participation in, the |
---|
52 | 52 | | demonstration project. The rules adopted by the executive |
---|
53 | 53 | | commissioner under this subsection shall ensure that the household |
---|
54 | 54 | | income of each child participating in the demonstration project is |
---|
55 | 55 | | verified: |
---|
56 | 56 | | (1) not more than twice during the 12-month period |
---|
57 | 57 | | during which a child remains eligible to receive medical assistance |
---|
58 | 58 | | program benefits, including at the time eligibility under the |
---|
59 | 59 | | program is recertified; and |
---|
60 | 60 | | (2) at the same time as each other child residing in |
---|
61 | 61 | | the same household who is eligible for medical assistance program |
---|
62 | 62 | | benefits. |
---|
63 | 63 | | (c) If feasible, the commission shall operate the |
---|
64 | 64 | | demonstration project established under this section in |
---|
65 | 65 | | conjunction with the demonstration project established under |
---|
66 | 66 | | Section 62.1025, Health and Safety Code. |
---|
67 | 67 | | (d) Not later than December 1, 2022, the commission shall |
---|
68 | 68 | | submit a report to the legislature regarding the commission's |
---|
69 | 69 | | progress in establishing and operating the demonstration project |
---|
70 | 70 | | and recommendations on continuing or expanding the demonstration |

---|
73 | 73 | | SECTION 3. Not later than September 1, 2020, the Health and |
---|
74 | 74 | | Human Services Commission shall implement the eligibility renewal |
---|
75 | 75 | | and eligibility recertification demonstration projects required by |
---|
76 | 76 | | Section 62.1025, Health and Safety Code, as added by this Act, and |
---|
77 | 77 | | Section 32.02614, Human Resources Code, as added by this Act. |
---|
78 | 78 | | SECTION 4. If before implementing any provision of this Act |
---|
79 | 79 | | a state agency determines that a waiver or authorization from a |
---|
80 | 80 | | federal agency is necessary for implementation of that provision, |
---|
81 | 81 | | the agency affected by the provision shall request the waiver or |
---|
82 | 82 | | authorization and may delay implementing that provision until the |
---|
83 | 83 | | waiver or authorization is granted. |
---|
84 | 84 | | SECTION 5. This Act takes effect immediately if it receives |
---|
85 | 85 | | a vote of two-thirds of all the members elected to each house, as |
---|
86 | 86 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
87 | 87 | | Act does not receive the vote necessary for immediate effect, this |
---|
88 | 88 | | Act takes effect September 1, 2019. |
