66 AN ACT
77 relating to demonstration projects to coordinate eligibility
88 renewal and eligibility recertification for certain children in the
99 Medicaid and child health plan programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 62, Health and Safety
1212 Code, is amended by adding Section 62.1025 to read as follows:
1313 Sec. 62.1025. ELIGIBILITY RENEWAL DEMONSTRATION PROJECT.
1414 (a) The commission shall establish a demonstration project in one
1515 or more geographic areas of this state through the child health plan
1616 program to allow the commission to simultaneously renew the
1717 eligibility and review the household income of each child residing
1818 in the same household who is eligible for enrollment in the program.
1919 (b) The executive commissioner shall adopt rules to
2020 determine the scope of, and eligibility for participation in, the
2121 demonstration project. The rules adopted by the executive
2222 commissioner under this subsection shall ensure that the household
2323 income of each child participating in the demonstration project is
2424 reviewed:
2525 (1) not more than twice during the 12-month period
2626 during which a child remains eligible to receive child health plan
2727 program benefits, including at the time eligibility under the
2828 program is renewed; and
2929 (2) at the same time as each other child residing in
3030 the same household who is eligible for enrollment in the program.
3131 (c) If feasible, the commission shall operate the
3232 demonstration project established under this section in
3333 conjunction with the demonstration project established under
3434 Section 32.02614, Human Resources Code.
3535 (d) Not later than December 1, 2022, the commission shall
3636 submit a report to the legislature regarding the commission's
3737 progress in establishing and operating the demonstration project
3838 and recommendations on continuing or expanding the demonstration
3939 project.
4040 (e) This section expires September 1, 2023.
4141 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
4242 is amended by adding Section 32.02614 to read as follows:
4343 Sec. 32.02614. ELIGIBILITY RECERTIFICATION DEMONSTRATION
4444 PROJECT. (a) The commission shall establish a demonstration
4545 project in one or more geographic areas of this state through the
4646 medical assistance program to allow the commission to
4747 simultaneously recertify the eligibility and verify the household
4848 income of each child residing in the same household who is eligible
4949 for medical assistance under this chapter.
5050 (b) The executive commissioner shall adopt rules to
5151 determine the scope of, and eligibility for participation in, the
5252 demonstration project. The rules adopted by the executive
5353 commissioner under this subsection shall ensure that the household
5454 income of each child participating in the demonstration project is
5555 verified:
5656 (1) not more than twice during the 12-month period
5757 during which a child remains eligible to receive medical assistance
5858 program benefits, including at the time eligibility under the
5959 program is recertified; and
6060 (2) at the same time as each other child residing in
6161 the same household who is eligible for medical assistance program
6262 benefits.
6363 (c) If feasible, the commission shall operate the
6464 demonstration project established under this section in
6565 conjunction with the demonstration project established under
6666 Section 62.1025, Health and Safety Code.
6767 (d) Not later than December 1, 2022, the commission shall
6868 submit a report to the legislature regarding the commission's
6969 progress in establishing and operating the demonstration project
7070 and recommendations on continuing or expanding the demonstration
7171 project.
7272 (e) This section expires September 1, 2023.
7373 SECTION 3. Not later than September 1, 2020, the Health and
7474 Human Services Commission shall implement the eligibility renewal
7575 and eligibility recertification demonstration projects required by
7676 Section 62.1025, Health and Safety Code, as added by this Act, and
7777 Section 32.02614, Human Resources Code, as added by this Act.
7878 SECTION 4. If before implementing any provision of this Act
7979 a state agency determines that a waiver or authorization from a
8080 federal agency is necessary for implementation of that provision,
8181 the agency affected by the provision shall request the waiver or
8282 authorization and may delay implementing that provision until the
8383 waiver or authorization is granted.
8484 SECTION 5. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2019.
