66 AN ACT
77 relating to the re-creation of the Chronic Kidney Disease Task
88 Force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act shall be known as the Glenda Dawson Act.
1111 SECTION 2. The state finds that the treatment of chronic
1212 kidney disease is a tremendous expense and that the early diagnosis
1313 and effective treatment of chronic kidney disease can prolong lives
1414 and delay the high cost of medical treatment, including dialysis
1515 and transplantation.
1616 SECTION 3. Subtitle D, Title 2, Health and Safety Code, is
1717 amended by adding Chapter 83 to read as follows:
1818 CHAPTER 83. CHRONIC KIDNEY DISEASE TASK FORCE
1919 Sec. 83.001. DEFINITION. In this chapter, "task force"
2020 means the Chronic Kidney Disease Task Force.
2121 Sec. 83.002. CHRONIC KIDNEY DISEASE TASK FORCE. (a) The
2222 Chronic Kidney Disease Task Force is composed of:
2323 (1) 20 members appointed by the governor as follows:
2424 (A) one family practice physician;
2525 (B) one pathologist;
2626 (C) one nephrologist from a nephrology
2727 department of a state medical school;
2828 (D) one nephrologist in private practice;
2929 (E) one representative from the National Kidney
3030 Foundation;
3131 (F) one representative from the Texas Kidney
3232 Foundation;
3333 (G) one representative from the South Plains
3434 Kidney Foundation of West Texas;
3535 (H) one representative from the Texas Renal
3636 Coalition;
3737 (I) one representative from the commission's
3838 Kidney Health Care Program;
3939 (J) one representative of an insurer that issues
4040 a preferred provider benefit plan or of a health maintenance
4141 organization;
4242 (K) one representative of clinical laboratories;
4343 (L) one representative of private renal care
4444 providers;
4545 (M) one pediatrician in private practice;
4646 (N) one kidney transplant surgeon;
4747 (O) one primary care physician;
4848 (P) one licensed and certified renal dietitian;
4949 (Q) one certified nephrology nurse;
5050 (R) one representative from a health care system;
5151 (S) one representative of the commission whose
5252 duties involve the state Medicaid program; and
5353 (T) one end stage renal disease expert;
5454 (2) two members of the senate appointed by the
5555 lieutenant governor; and
5656 (3) two members of the house of representatives
5757 appointed by the speaker of the house of representatives.
5858 (b) The governor shall designate a member of the task force
5959 to serve as the presiding officer of the task force. The presiding
6060 officer serves at the will of the governor.
6161 (c) Appointments to the task force shall be made without
6262 regard to the race, color, disability, sex, religion, age, or
6363 national origin of the appointees.
6464 Sec. 83.003. DUTIES. The task force shall:
6565 (1) coordinate implementation of the state's
6666 cost-effective plan for prevention, early screening, diagnosis,
6767 and management of chronic kidney disease for the state's population
6868 through national, state, and local partners; and
6969 (2) educate health care professionals on the use of
7070 clinical practice guidelines for screening, detecting, diagnosing,
7171 treating, and managing chronic kidney disease, its comorbidities,
7272 and its complications based on the Kidney Disease Outcomes Quality
7373 Initiative Clinical Practice Guidelines for Chronic Kidney
7474 Disease.
7575 Sec. 83.004. REIMBURSEMENT. A member of the task force may
7676 receive reimbursement for travel expenses as provided by Section
7777 2110.004, Government Code.
7878 Sec. 83.005. ASSISTANCE. The commission shall provide
7979 administrative support to the task force, including necessary staff
8080 and meeting facilities.
8181 Sec. 83.006. REPORT. Not later than January 1 of each
8282 odd-numbered year, the task force shall submit its findings and
8383 recommendations to:
8484 (1) the governor, lieutenant governor, and speaker of
8585 the house of representatives; and
8686 (2) the presiding officers of the appropriate standing
8787 committees of the legislature with jurisdiction over health issues.
8888 Sec. 83.007. FUNDING. (a) The task force, through the
8989 commission, may accept gifts and grants from individuals, private
9090 or public organizations, or federal or local funds to support the
9191 task force.
9292 (b) The commission shall investigate any potential sources
9393 of funding from federal grants or programs.
9494 Sec. 83.008. APPLICABILITY OF OTHER LAW. Except as
9595 specifically provided by this chapter, Chapter 2110, Government
9696 Code, does not apply to the task force.
9797 Sec. 83.009. TASK FORCE REVIEW AND ABOLISHMENT. (a) The
9898 commission shall review the continued need for the task force at
9999 least once every five years.
100100 (b) If the commission determines the task force is no longer
101101 needed and should be abolished, the commission shall publish notice
102102 of its decision in the Texas Register and on the commission's
103103 Internet website.
104104 (c) The task force is abolished on the date stated in the
105105 notice required by Subsection (b).
106106 SECTION 4. Not later than January 1, 2020, the governor,
107107 lieutenant governor, and speaker of the house of representatives
108108 shall appoint the members to the Chronic Kidney Disease Task Force
109109 as required by Section 83.002, Health and Safety Code, as added by
110110 this Act.
111111 SECTION 5. This Act takes effect September 1, 2019.
