7 | 7 | | relating to health care data collection requirements and a |
---|
8 | 8 | | feasibility study on the use of the data to create a database of |
---|
9 | 9 | | amounts billed for certain health care services. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 108.002(10), Health and Safety Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (10) "Health care facility" means: |
---|
14 | 14 | | (A) a hospital; |
---|
15 | 15 | | (B) an ambulatory surgical center licensed under |
---|
16 | 16 | | Chapter 243; |
---|
17 | 17 | | (C) a chemical dependency treatment facility |
---|
18 | 18 | | licensed under Chapter 464; |
---|
19 | 19 | | (D) a renal dialysis facility; |
---|
20 | 20 | | (E) a birthing center; |
---|
21 | 21 | | (F) a rural health clinic; |
---|
22 | 22 | | (G) a federally qualified health center as |
---|
23 | 23 | | defined by 42 U.S.C. Section 1396d(l)(2)(B); [or] |
---|
24 | 24 | | (H) a free-standing imaging center; or |
---|
25 | 25 | | (I) a freestanding emergency medical care |
---|
26 | 26 | | facility, as defined by Section 254.001, including a freestanding |
---|
27 | 27 | | emergency medical care facility that is exempt from the licensing |
---|
28 | 28 | | requirements of Chapter 254 under Section 254.052(8). |
---|
29 | 29 | | SECTION 2. (a) In this section, "department" means the |
---|
30 | 30 | | Department of State Health Services. |
---|
31 | 31 | | (b) The department shall conduct a study on the feasibility |
---|
32 | 32 | | of using the information provided to the department under the |
---|
33 | 33 | | statewide health care data collection system developed under |
---|
34 | 34 | | Section 108.006, Health and Safety Code, for creating a database |
---|
35 | 35 | | accessible through the Texas Health Care Information Collection |
---|
36 | 36 | | website. The database must: |
---|
37 | 37 | | (1) be searchable; |
---|
38 | 38 | | (2) include the average and percentile billed charges |
---|
39 | 39 | | for health care procedures performed at inpatient care facilities, |
---|
40 | 40 | | outpatient care facilities, and hospital outpatient departments; |
---|
41 | 41 | | and |
---|
42 | 42 | | (3) categorize the information described by |
---|
43 | 43 | | Subdivision (2) of this subsection according to the American |
---|
44 | 44 | | Medical Association's Current Procedural Terminology code for the |
---|
45 | 45 | | health care procedure associated with the amount billed. |
---|
46 | 46 | | (c) In conducting the feasibility study under Subsection |
---|
47 | 47 | | (b) of this section, the department shall evaluate the cost of |
---|
48 | 48 | | making the database accessible to: |
---|
49 | 49 | | (1) the public at no cost; |
---|
50 | 50 | | (2) health care providers at a cost; and |
---|
51 | 51 | | (3) both the public at no cost and health care |
---|
52 | 52 | | providers at a cost. |
---|
53 | 53 | | (d) Not later than December 1, 2020, the department shall |
---|
54 | 54 | | report the results of the study required under this section to the |
---|
55 | 55 | | governor, the lieutenant governor, the speaker of the house of |
---|
56 | 56 | | representatives, and members of the appropriate standing |
---|
57 | 57 | | committees of the senate and the house of representatives. |
---|
58 | 58 | | (e) The department may contract with a third-party entity to |
---|
59 | 59 | | conduct the study required under this section. |
---|
60 | 60 | | (f) This section expires September 1, 2021. |
---|
61 | 61 | | SECTION 3. This Act takes effect September 1, 2019. |
