55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of school district policies regarding
88 the marketing and commercial advertising of food products on school
99 district property.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 28.004, Education Code, is amended by
1212 adding Subsection (p) to read as follows:
1313 (p) The local school health advisory council shall:
1414 (1) conduct a review of the school district policies
1515 regarding the marketing and commercial advertising on district
1616 property of food products that are not offered through the school
1717 meal program;
1818 (2) determine the extent to which the marketing and
1919 commercial advertising on district property of food products that
2020 are not offered through the school meal program conflict with
2121 recommendations developed by the council as required by Subsection
2222 (c)(2); and
2323 (3) recommend:
2424 (A) policies, procedures, strategies, and
2525 curricula for the district to diminish the negative health
2626 consequences, including obesity, cardiovascular disease, and Type
2727 2 diabetes, related to the marketing and commercial advertising on
2828 district property of food products that are not offered through the
2929 school meal program; and
3030 (B) the extent to which marketing and commercial
3131 advertising on district property of food products that are not
3232 offered through the school meal program should be allowed.
3333 SECTION 2. This Act takes effect September 1, 2019.
