7 | 7 | | relating to the establishment of school district policies regarding |

8 | 8 | | the marketing and commercial advertising of food products on school |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 28.004, Education Code, is amended by |
---|
12 | 12 | | adding Subsection (p) to read as follows: |
---|
13 | 13 | | (p) The local school health advisory council shall: |
---|
14 | 14 | | (1) conduct a review of the school district policies |
---|
15 | 15 | | regarding the marketing and commercial advertising on district |
---|
16 | 16 | | property of food products that are not offered through the school |
---|
17 | 17 | | meal program; |
---|
18 | 18 | | (2) determine the extent to which the marketing and |
---|
19 | 19 | | commercial advertising on district property of food products that |
---|
20 | 20 | | are not offered through the school meal program conflict with |
---|
21 | 21 | | recommendations developed by the council as required by Subsection |
---|
22 | 22 | | (c)(2); and |
---|
23 | 23 | | (3) recommend: |
---|
24 | 24 | | (A) policies, procedures, strategies, and |
---|
25 | 25 | | curricula for the district to diminish the negative health |
---|
26 | 26 | | consequences, including obesity, cardiovascular disease, and Type |
---|
27 | 27 | | 2 diabetes, related to the marketing and commercial advertising on |
---|
28 | 28 | | district property of food products that are not offered through the |
---|
29 | 29 | | school meal program; and |
---|
30 | 30 | | (B) the extent to which marketing and commercial |
---|
31 | 31 | | advertising on district property of food products that are not |
---|
32 | 32 | | offered through the school meal program should be allowed. |

33 | 33 | | SECTION 2. This Act takes effect September 1, 2019. |
