66 AN ACT
77 relating to a study regarding the costs of educating students with
88 disabilities in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1111 amended by adding Section 29.025 to read as follows:
1212 Sec. 29.025. STUDY REGARDING COSTS OF EDUCATING STUDENTS
1313 WITH DISABILITIES; REPORT. (a) The agency shall conduct a study to
1414 examine the costs of educating a student with disabilities under
1515 this subchapter, including an analysis of the different services
1616 provided. The study must:
1717 (1) determine whether the special education allotment
1818 under Section 42.151 provides adequate funding to schools for
1919 meeting the educational needs of students with disabilities; and
2020 (2) if it is determined under Subdivision (1) that the
2121 special education allotment is inadequate, determine the amount of
2222 adjustment for the special education allotment that would provide
2323 adequate funding to schools for meeting the educational needs of
2424 students with disabilities.
2525 (b) Not later than November 1, 2020, the agency shall
2626 prepare a report detailing the results of the study under this
2727 section and electronically submit the report to each standing
2828 legislative committee with primary jurisdiction over primary and
2929 secondary education.
3030 (c) This section expires September 1, 2021.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2019.
