| 7 | 7 | | relating to a study regarding the costs of educating students with |
|---|
| 8 | 8 | | disabilities in public schools. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 29.025 to read as follows: |
|---|
| 12 | 12 | | Sec. 29.025. STUDY REGARDING COSTS OF EDUCATING STUDENTS |
|---|
| 13 | 13 | | WITH DISABILITIES; REPORT. (a) The agency shall conduct a study to |
|---|
| 14 | 14 | | examine the costs of educating a student with disabilities under |
|---|
| 15 | 15 | | this subchapter, including an analysis of the different services |
|---|
| 16 | 16 | | provided. The study must: |
|---|
| 17 | 17 | | (1) determine whether the special education allotment |
|---|
| 18 | 18 | | under Section 42.151 provides adequate funding to schools for |
|---|
| 19 | 19 | | meeting the educational needs of students with disabilities; and |
|---|
| 20 | 20 | | (2) if it is determined under Subdivision (1) that the |
|---|
| 21 | 21 | | special education allotment is inadequate, determine the amount of |
|---|
| 22 | 22 | | adjustment for the special education allotment that would provide |
|---|
| 23 | 23 | | adequate funding to schools for meeting the educational needs of |
|---|
| 24 | 24 | | students with disabilities. |
|---|
| 25 | 25 | | (b) Not later than November 1, 2020, the agency shall |
|---|
| 26 | 26 | | prepare a report detailing the results of the study under this |
|---|
| 27 | 27 | | section and electronically submit the report to each standing |
|---|
| 28 | 28 | | legislative committee with primary jurisdiction over primary and |
|---|
| 29 | 29 | | secondary education. |
|---|
| 30 | 30 | | (c) This section expires September 1, 2021. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2019. |
|---|
