66 AN ACT
77 relating to identification and development of mental health
88 resources for students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 38, Education Code, is amended by adding
1111 Subchapter F to read as follows:
1212 SUBCHAPTER F. MENTAL HEALTH RESOURCES
1313 Sec. 38.251. RUBRIC TO IDENTIFY RESOURCES. (a) The agency
1414 shall develop a rubric for use by regional education service
1515 centers in identifying resources related to student mental health
1616 that are available to schools in their respective regions. The
1717 agency shall develop the rubric in conjunction with:
1818 (1) the Health and Human Services Commission;
1919 (2) the Department of Family and Protective Services;
2020 (3) the Texas Juvenile Justice Department;
2121 (4) the Texas Higher Education Coordinating Board;
2222 (5) the Texas Workforce Commission; and
2323 (6) any other state agency the agency considers
2424 appropriate.
2525 (b) The rubric developed by the agency must provide for the
2626 identification of resources relating to:
2727 (1) training and technical assistance on practices
2828 that support the mental health of students;
2929 (2) school-based programs that provide prevention or
3030 intervention services to students;
3131 (3) community-based programs that provide
3232 school-based or school-connected prevention or intervention
3333 services to students;
3434 (4) school-based mental health providers; and
3535 (5) public and private funding sources available to
3636 address the mental health of students.
3737 (c) Not later than December 1 of each odd-numbered year, the
3838 agency shall revise the rubric as necessary to reflect changes in
3939 resources that may be available to schools and provide the rubric to
4040 each regional education service center.
4141 Sec. 38.252. REGIONAL INVENTORY OF MENTAL HEALTH RESOURCES.
4242 (a) Each regional education service center shall use the rubric
4343 developed under Section 38.251 to identify resources related to
4444 student mental health available to schools in the center's region,
4545 including evidence-based and promising programs and best
4646 practices, that:
4747 (1) create school environments that support the
4848 social, emotional, and academic development of students;
4949 (2) identify students who may need additional
5050 behavioral or mental health support before issues arise;
5151 (3) provide early, effective interventions to
5252 students in need of additional support;
5353 (4) connect students and their families to specialized
5454 services in the school or community when needed; and
5555 (5) assist schools in aligning resources necessary to
5656 address the mental health of students.
5757 (b) A regional education service center may consult with any
5858 entity the center considers necessary in identifying resources
5959 under Subsection (a), including:
6060 (1) school districts;
6161 (2) local mental health authorities;
6262 (3) community mental health services providers;
6363 (4) education groups;
6464 (5) hospitals; and
6565 (6) institutions of higher education.
6666 (c) Not later than March 1 of each even-numbered year, each
6767 regional education service center shall:
6868 (1) use the revised rubric received from the agency
6969 under Section 38.251 to identify, in the manner provided by this
7070 section, any additional resources that may be available to schools
7171 in the center's region; and
7272 (2) submit to the agency a report on resources
7373 identified through the process, including any additional resources
7474 identified under Subdivision (1).
7575 Sec. 38.253. STATEWIDE INVENTORY OF MENTAL HEALTH
7676 RESOURCES. (a) The agency shall develop a list of statewide
7777 resources available to school districts to address the mental
7878 health of students, including:
7979 (1) training and technical assistance on practices
8080 that support the mental health of students;
8181 (2) school-based programs that provide prevention or
8282 intervention services to students;
8383 (3) community-based programs that provide
8484 school-based or school-connected prevention or intervention
8585 services to students;
8686 (4) school-based mental health providers; and
8787 (5) public and private funding sources available to
8888 address the mental health of students.
8989 (b) In developing the list required under Subsection (a),
9090 the agency shall collaborate with:
9191 (1) the Health and Human Services Commission;
9292 (2) the Department of Family and Protective Services;
9393 (3) the Texas Juvenile Justice Department;
9494 (4) the Texas Higher Education Coordinating Board;
9595 (5) the Texas Workforce Commission;
9696 (6) hospitals or other health care providers;
9797 (7) community service providers;
9898 (8) parent, educator, and advocacy groups; and
9999 (9) any entity the agency determines can assist the
100100 agency in compiling the list.
101101 (c) The agency shall include on the list any resource
102102 available through an entity identified as a resource under
103103 Subsection (b), including an entity described by Subsection (b),
104104 that provides evidence-based and promising programs and best
105105 practices that:
106106 (1) create school environments that support the
107107 social, emotional, and academic development of students;
108108 (2) identify students who may need additional
109109 behavioral or mental health support before issues arise;
110110 (3) provide early, effective interventions to
111111 students in need of additional support; and
112112 (4) connect students and their families to specialized
113113 services in the school or community when needed.
114114 (d) The agency shall revise the list not later than March 1
115115 of each even-numbered year.
116116 Sec. 38.254. STATEWIDE PLAN FOR STUDENT MENTAL HEALTH. (a)
117117 The agency shall develop a statewide plan to ensure all students
118118 have access to adequate mental health resources. The agency shall
119119 include in the plan:
120120 (1) a description of any revisions made to the rubric
121121 required by Section 38.251;
122122 (2) the results of the most recent regional inventory
123123 of mental health resources required by Section 38.252, including
124124 any additional resources identified;
125125 (3) the results of the most recent statewide inventory
126126 of mental health resources required by Section 38.253, including
127127 any additional resources identified;
128128 (4) the agency's goals for student mental health
129129 access to be applied across the state, including goals relating to:
130130 (A) methods to objectively measure positive
131131 school climate;
132132 (B) increasing the availability of early,
133133 effective school-based or school-connected mental health
134134 interventions and resources for students in need of additional
135135 support; and
136136 (C) increasing the availability of referrals for
137137 students and families to specialized services for students in need
138138 of additional support outside the school;
139139 (5) a list of actions the commissioner may take
140140 without legislative action to help all districts reach the agency's
141141 goals described by the plan; and
142142 (6) recommendations to the legislature on methods to
143143 ensure that all districts can meet the agency's goals described in
144144 the plan through legislative appropriations or other action by the
145145 legislature.
146146 (b) In developing the agency's goals under Subsection
147147 (a)(4), the agency shall consult with any person the agency
148148 believes is necessary to the development of the goals, including:
149149 (1) educators;
150150 (2) mental health practitioners;
151151 (3) advocacy groups; and
152152 (4) parents.
153153 (c) The agency shall revise the plan not later than April 1
154154 of each even-numbered year.
155155 (d) As soon as practicable after completing or revising the
156156 plan, the agency shall:
157157 (1) submit an electronic copy of the plan to the
158158 legislature;
159159 (2) post the plan on the agency's Internet website; and
160160 (3) hold public meetings in each regional education
161161 service center's region to present the statewide plan and shall
162162 provide an opportunity for public comment at each meeting.
163163 Sec. 38.255. AGENCY USE OF STATEWIDE PLAN. (a) The agency
164164 shall use the statewide plan for student mental health required by
165165 Section 38.254 to develop and revise the agency's long-term
166166 strategic plan.
167167 (b) The agency shall use the recommendations to the
168168 legislature required by Section 38.254(a)(6) to develop each agency
169169 legislative appropriations request.
170170 Sec. 38.256. REPORTS TO LEGISLATURE. In addition to any
171171 other information required to be provided to the legislature under
172172 this chapter, not later than November 1 of each even-numbered year
173173 the agency shall provide to the legislature:
174174 (1) a description of any changes the agency has made to
175175 the rubric required by Section 38.251; and
176176 (2) an analysis of each region's progress toward
177177 meeting the agency's goals developed under Section 38.254.
178178 SECTION 2. (a) Not later than December 1, 2019, the Texas
179179 Education Agency shall develop and distribute to each regional
180180 education service center the rubric required by Section 38.251,
181181 Education Code, as added by this Act.
182182 (b) Not later than March 1, 2020:
183183 (1) each regional education service center shall
184184 complete the regional inventory of mental health resources required
185185 by Section 38.252, Education Code, as added by this Act, and report
186186 to the Texas Education Agency on the resources identified through
187187 the inventory; and
188188 (2) the Texas Education Agency shall complete the
189189 statewide inventory of mental health resources required by Section
190190 38.253, Education Code, as added by this Act, and develop a list of
191191 resources available to school districts statewide to address the
192192 mental health of students.
193193 (c) Not later than April 1, 2020, the Texas Education Agency
194194 shall develop the statewide plan for student mental health required
195195 by Section 38.254, Education Code, as added by this Act, submit an
196196 electronic copy of the plan to the legislature, and post the plan on
197197 the agency's Internet website.
198198 SECTION 3. This Act takes effect immediately if it receives
199199 a vote of two-thirds of all the members elected to each house, as
200200 provided by Section 39, Article III, Texas Constitution. If this
201201 Act does not receive the vote necessary for immediate effect, this
202202 Act takes effect September 1, 2019.
