76 relating to organized election fraud activity; imposing a civil

98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Chapter 276, Election Code, is amended by adding
1110 Section 276.012 to read as follows:
1211 Sec. 276.012. LIABILITY FOR ENGAGING IN ORGANIZED ELECTION
1312 FRAUD ACTIVITY. (a) In this section, "organized election fraud
1413 activity" means an offense under Section 276.011(a).
1514 (b) A person who engages in organized election fraud
1615 activity in connection with an election in this state is liable to
1716 the state for civil penalties in an action by the attorney general
1817 as provided by this section.
1918 (c) In an action under this section, the attorney general
2019 may seek injunctive relief to prevent a violation of Section
2120 276.011(a) from continuing or recurring.
2221 (d) In an action under this section, the attorney general
2322 must establish each element of the action by a preponderance of the
2423 evidence.
2524 (e) It is not a defense under this section that:
2625 (1) a defendant is not criminally responsible for an
2726 offense committed in furtherance of the organized election fraud
2827 activity; or
2928 (2) another alleged participant in the organized
3029 election fraud activity has been acquitted.
3130 (f) In all actions under this section, the state shall be
3231 awarded a civil penalty of $1,000 for each offense committed under
3332 Titles 1 through 7 in the course of committing organized election
3433 fraud activity.
3534 (g) The cause of action created by this section is
3635 cumulative of any other remedy provided by common law or statute.
3736 (h) A person found liable under this section or other law
3837 for any amount of damages arising from organized election fraud
3938 activity is jointly liable with any other defendant for the entire
4039 amount of damages arising from the activity.
4140 (i) A civil action or proceeding under this section against
4241 any person may be brought in the county where any part of the
4342 organized election fraud activity occurred.
4443 SECTION 2. The change in law made by this Act applies only
4544 to an offense committed under Section 276.011(a), Election Code, on
4645 or after the effective date of this Act. An offense committed
4746 before the effective date of this Act is governed by the law in
4847 effect on the date the offense was committed, and the former law is
4948 continued in effect for that purpose. For purposes of this section,
5049 an offense was committed before the effective date of this Act if
5150 any element of the offense occurred before that date.
5251 SECTION 3. This Act takes effect September 1, 2019.
