9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. Chapter 276, Election Code, is amended by adding |
---|
11 | 10 | | Section 276.012 to read as follows: |
---|
12 | 11 | | Sec. 276.012. LIABILITY FOR ENGAGING IN ORGANIZED ELECTION |
---|
13 | 12 | | FRAUD ACTIVITY. (a) In this section, "organized election fraud |
---|
14 | 13 | | activity" means an offense under Section 276.011(a). |
---|
15 | 14 | | (b) A person who engages in organized election fraud |
---|
16 | 15 | | activity in connection with an election in this state is liable to |
---|
17 | 16 | | the state for civil penalties in an action by the attorney general |
---|
18 | 17 | | as provided by this section. |
---|
19 | 18 | | (c) In an action under this section, the attorney general |
---|
20 | 19 | | may seek injunctive relief to prevent a violation of Section |
---|
21 | 20 | | 276.011(a) from continuing or recurring. |
---|
22 | 21 | | (d) In an action under this section, the attorney general |
---|
23 | 22 | | must establish each element of the action by a preponderance of the |
---|
24 | 23 | | evidence. |
---|
25 | 24 | | (e) It is not a defense under this section that: |
---|
26 | 25 | | (1) a defendant is not criminally responsible for an |
---|
27 | 26 | | offense committed in furtherance of the organized election fraud |
---|
28 | 27 | | activity; or |
---|
29 | 28 | | (2) another alleged participant in the organized |
---|
30 | 29 | | election fraud activity has been acquitted. |
---|
31 | 30 | | (f) In all actions under this section, the state shall be |
---|
32 | 31 | | awarded a civil penalty of $1,000 for each offense committed under |
---|
33 | 32 | | Titles 1 through 7 in the course of committing organized election |
---|
34 | 33 | | fraud activity. |
---|
35 | 34 | | (g) The cause of action created by this section is |
---|
36 | 35 | | cumulative of any other remedy provided by common law or statute. |
---|
37 | 36 | | (h) A person found liable under this section or other law |
---|
38 | 37 | | for any amount of damages arising from organized election fraud |
---|
39 | 38 | | activity is jointly liable with any other defendant for the entire |
---|
40 | 39 | | amount of damages arising from the activity. |
---|
41 | 40 | | (i) A civil action or proceeding under this section against |
---|
42 | 41 | | any person may be brought in the county where any part of the |
---|
43 | 42 | | organized election fraud activity occurred. |
---|
44 | 43 | | SECTION 2. The change in law made by this Act applies only |
---|
45 | 44 | | to an offense committed under Section 276.011(a), Election Code, on |
---|
46 | 45 | | or after the effective date of this Act. An offense committed |
---|
47 | 46 | | before the effective date of this Act is governed by the law in |
---|
48 | 47 | | effect on the date the offense was committed, and the former law is |
---|
49 | 48 | | continued in effect for that purpose. For purposes of this section, |
---|
50 | 49 | | an offense was committed before the effective date of this Act if |
---|
51 | 50 | | any element of the offense occurred before that date. |
---|
52 | 51 | | SECTION 3. This Act takes effect September 1, 2019. |
