96 relating to municipal registration of vacant buildings in certain
107 municipalities.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 214.233, Local Government Code, is
13- amended by adding Subsections (a-1) and (a-2) to read as follows:
14- (a-1) A municipality located in a county that has a
15- population of more than 285,000 and less than 300,000 and borders
16- the Gulf of Mexico may adopt an ordinance that allows but does not
17- require owners of vacant buildings to register their buildings by
18- filing a registration form with a designated municipal official. A
19- municipality that adopts an ordinance under this subsection may not
20- place a lien on a property solely because the property is registered
21- under this subsection.
22- (a-2) Subsection (a) may not be construed to grant a
23- municipality authority other than the authority to adopt an
24- ordinance described by that subsection.
9+ SECTION 1. Section 214.233(a), Local Government Code, is
10+ amended to read as follows:
11+ (a) A municipality [located in a county with a population of
12+ two million or more] may adopt an ordinance requiring owners of
13+ vacant buildings to register their buildings by filing a
14+ registration form with a designated municipal official if the
15+ municipality is located in:
16+ (1) a county that has a population of two million or
17+ more; or
18+ (2) a county that:
19+ (A) has a population of more than 285,000 and
20+ less than 300,000; and
21+ (B) borders the Gulf of Mexico.
2522 SECTION 2. This Act takes effect immediately if it receives
2623 a vote of two-thirds of all the members elected to each house, as
2724 provided by Section 39, Article III, Texas Constitution. If this
2825 Act does not receive the vote necessary for immediate effect, this
2926 Act takes effect September 1, 2019.
