55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing criminal penalties for the offense of making
88 a firearm accessible to a child.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 46.13(d) and (e), Penal Code, are
1111 amended to read as follows:
1212 (d) Except as provided by Subsection (e), an offense under
1313 this section is a Class B [C] misdemeanor.
1414 (e) An offense under this section is a state jail felony
1515 [Class A misdemeanor] if the child discharges the firearm and
1616 causes death or serious bodily injury to the child [himself] or
1717 another person.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2019.
