77 relating to the sources of supply of water for certain municipally
88 owned water utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 552, Local Government
1111 Code, is amended by adding Section 552.025 to read as follows:
1212 Sec. 552.025. MULTIPLE SOURCES OF SUPPLY FOR CERTAIN
1313 MUNICIPALLY OWNED UTILITIES. (a) In this section, "municipally
1414 owned utility" and "utility" have the meanings assigned by Section
1515 13.002, Water Code.
1616 (b) This section applies only to a municipally owned utility
1717 that serves:
1818 (1) a municipality with a population of more than
1919 500,000; and
2020 (2) offices or other facilities of a state agency.
2121 (c) A municipally owned utility shall have at least two
2222 sources of water supply available to the utility for the purposes of
2323 the provision of its services.
2424 (d) A municipally owned utility that on the effective date
2525 of this section is not in compliance with the requirement of
2626 Subsection (c) immediately shall acquire, develop, or contract for
2727 one or more alternative sources of water for the provision of its
2828 services so that the utility meets that requirement before
2929 September 1, 2023. This subsection expires September 1, 2025.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
