8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 623.0172, Transportation Code, is | |
10 | 10 | amended by amending Subsection (h) and adding Subsection (h-1) to | |
11 | 11 | read as follows: | |
12 | 12 | (h) Except as provided by Subsection (h-1), [The department | |
13 | 13 | shall initially set] the fee for a permit issued under this section | |
14 | 14 | is $400 [in an amount not to exceed $2,000]. This subsection | |
15 | 15 | expires December 1, 2022. | |
16 | 16 | (h-1) Beginning in 2022, on September 1 of each | |
17 | 17 | even-numbered year the department shall set the fee for a permit | |
18 | 18 | issued under this section in an amount based on a reasonable | |
19 | 19 | estimate of the costs associated with the operation of vehicles | |
20 | 20 | issued a permit under this section over routes described by | |
21 | 21 | Subsection (c), including any increase in the costs necessary to | |
22 | 22 | maintain or repair those highways. The estimate shall be based on | |
23 | 23 | the results of the study conducted under Subsection (l). | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2019. |
